Social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary personal budget for the month in which the death occurred, and, as the case may be, social benefits due and unpaid until the time of death shall be paid to the surviving spouse, children, parents or, in their absence, to other heirs, according to common law, upon their request. The amounts mentioned above may be requested, at the territorial agency for payments and social inspection, by the heir, within the general limitation period, based on the document proving the status of heir, as well as, in the case where there are several heirs, a sworn statement that the other heirs are not requesting these amounts.
