Procedure for issuing the permit for the authorization of the execution of constructions of any kind located in the vicinity of the objectives/systems for natural gas distribution operated by Distrigaz Sud Retele SRL*

Based on Law 50/1991 regarding the authorization of construction works, with subsequent amendments and completions, and Order 47/2003 for the approval of the Procedure for issuing the approval for the authorization of constructions located in the vicinity of objectives/systems in the oil and natural gas sector, Distrigaz Sud Retele (DGSR) issues upon request:

- Siting approvals - issued for works involving construction/demolition; the fee is calculated according to the studied area. Examples of requests:

extension, consolidation, refurbishment, repartitioning, existing building
construction of a new building with/without connections, pedestrian and driveway alleys, fencing land
balcony construction, creating an exterior access opening, change of use of space
demolition of existing buildings
legalization of a building
park arrangement, parking, etc.

- Route approvals - issued for works involving the construction of utility networks/connections/branches/roads; the fee is calculated based on the length of the studied route. Examples of requests:

extensions/establishments of water, sewer, electric, thermal, telephone, gas pipelines
rehabilitation/establishment of roads, asphalting
relocations of water, sewer, electric, thermal, telephone, gas pipelines
replacements/rehabilitations/modernizations of water, sewer, electric, thermal, telephone, gas pipelines
water/sewer branch/connection
thermal connections
electric branch
gas branches/connections
tram line replacement; trolleybus line extension, etc.
road modernization, rehabilitation, etc.

- Preliminary approvals - are issued when the client requests information regarding the existence or not of DGSR networks on a land, in case of notary operations, feasibility or pre-feasibility studies or in the case of developing PUD, PUZ, PUG documentation; the fee is calculated according to the studied area. PUGs and general interest PUZ/PUDs are not charged; exemption from the PUZ/PUD fee applies based on a letter from the public institution accompanying the documentation, stating that the objective falls under the provisions of Law no. 350/2001 art. 56 para. 3. Examples of requests:

PUD, PUZ, PUG
notary operations: land transfer, partition, concession, etc.
network tracing
FS or pre FS
site organization

The approval represents the written response to an applicant's request, with technical and mandatory character, specifying the point of view regarding the fulfillment of the coexistence conditions of the proposed objective with the natural gas distribution networks of the operator Distrigaz Sud Retele.

The approval is obtained only after submitting the complete documentation consisting of: the standard request, the necessary documents mentioned in the standard request, and the proof of payment. Siting and route approvals are issued in a maximum of 5 working days from the date of submission of the complete documentation.

Preliminary approvals are issued in a maximum of 15 working days from the date of submission of the complete documentation.

The documentation can be submitted by a consultant, designer, or any other natural or legal person authorized by the holder of the urbanism certificate/requester.

For documentation with plans larger than A3 format, physical submission at the Distrigaz Sud Retele headquarters is mandatory and uploaded on CD in electronic .dwg format, scale 1:500 or 1:1000, in the Stereo '70 coordinate system with title block, legend, and cleaned of unused graphic elements and definitions – purge function.

The issuance of the approval consists of the following steps:

verification of documentation and request for completions, if necessary;
issuance and transmission of the Payment Note related to the requested type of approval; payment of the fee, submission of proof of payment and related documentation;
registration of the request;
analysis of documentation and invoicing;
identification and verification on site/GIS MAP of the DGSR objectives and the site for which approval is requested;
marking DGSR objectives on the site plan, visa of the site plan, and issuance of approval;
handover/transmission of approval to the applicant.

The applicable fees are valid starting 01.08.2024, are included in the List of Services/Related Activities of Distrigaz Sud Retele and fall under the provisions of Order 140/2015 of ANRE setting the regulated tariffs for activities related to the operation of the natural gas distribution system.Fees are calculated based on land area (for siting approvals), analyzed length (for route approvals), and/or number of plans. Fees are paid only based on the Payment Note (document reference in the payment document is mandatory).
