Request for license for public lighting service no. 20*

Request for license for the public lighting service, provided under the delegated management method by specialized providers established as commercial companies - https://www.anrsc.ro/gestiune-delegata-iluminat-public/

Processing time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities service operator of the additions requested by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the granting of a license for a public utility service/activity are analyzed by A.N.R.S.C., and in if necessary, the regulatory authority sends the applicant an address by which they are informed of the obligation to make additions, corrections, or clarifications, regarding the application and the submitted documents, within 30 days from the registration of the documentation.

If within 30 days from the date of the request for additions, the applicant does not provide all the correct documentation required by the regulation, including the requested additions, A.N.R.S.C. will return the related documentation, removing the respective application from the licensing procedure, communicating this decision to the applicant.

Depending on the way of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide: a) to summon, at the A.N.R.S.C. headquarters, the authorized representatives of the applicant, to clarify certain aspects that arise/do not arise from the documentation provided; b) to verify, on the spot, the reality of the data from the documentation submitted by the applicant.

A.N.R.S.C., through the specialized department, prepares a specialized report that includes the substantiated proposal for granting/rejecting the license and which will be presented for analysis to the Licensing Commission, by the secretary of the commission.

The proposal to grant/reject the license is submitted to a vote within the Licensing Commission.

The granting/rejection of the license is done by order of the president of A.N.R.S.C..

In the case of granting the license, A.N.R.S.C. communicates to the applicant the fiscal invoice for the licensing fee, which must be paid within a maximum of 30 days from the date of communication of the invoice.

After confirming the payment, A.N.R.S.C. sends the applicant, within a maximum of 5 days, the order of the president of A.N.R.S.C. for the granting of the license, accompanied by the license and its associated conditions.

In case the 30-day deadline for payment of the licensing fee is not met, A.N.R.S.C. will proceed to withdraw the license.

In case of refusal to grant the license, A.N.R.S.C. sends the applicant, within a maximum of 5 days from issuance, the order of the president of A.N.R.S.C. refusing the license, accompanied by the reasons for refusal.

In case the granting of the license is refused, the applicant may not submit a new licensing documentation earlier than 6 months from the date of issuing the order of refusal.

Final document:

a) Order for granting the license, accompanied by the license and the conditions associated with the license;

b) Order for rejection of the license, accompanied by the reasons for the refusal to grant;

c) Notification regarding removal of the application from the procedure.

Notification period upon expiration of the resolution period: 5 days from the date of confirmation of payment of the licensing fee, in case of granting the license, or 5 days from the date of issuance of the order of rejection of the license.

Request for license for public sewer service no. 12*

Request for license for public sewerage service, provided under the delegated management method by specialized providers established as commercial companies-https://www.anrsc.ro/gestiune-delegata-apa-canal/

Processing time: 60 days from the registration of the documentation or 30 days from the transmission by the public utility service operator of the additions requested by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the granting of a license for a public utility service/activity are analyzed by the A.N.R.S.C., and in case it is necessary, the regulatory authority sends the applicant a notice informing them of the obligation to make additions, corrections, or clarifications, regarding the application and submitted documents, within 30 days from the registration of the documentation.

If, within 30 days from the date of the request for additions, the applicant does not provide all the appropriate documentation stipulated by the regulation, including the requested additions, A.N.R.S.C. will return the respective documentation, deleting the application from the licensing procedure, communicating this decision to the applicant.

Depending on the manner of submission and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) summoning, at the A.N.R.S.C. headquarters, the authorized representatives of the applicant, to clarify certain aspects arising/not arising from the documentation provided;

b) on-site verification of the accuracy of the data in the documentation submitted by the applicant.

A.N.R.S.C., through the specialized department, draws up a report which includes the well-founded proposal for granting/rejecting the license and which will be submitted for analysis to the Licensing Commission, by the commission secretary.

The proposal to grant/reject the license is subject to a vote within the Licensing Commission.

The granting/rejection of the license is made by order of the A.N.R.S.C. president.

In case of granting the license, A.N.R.S.C. communicates to the applicant the tax invoice for the license fee, which must be paid no later than 30 days from the date of communication of the invoice.

After payment confirmation A.N.R.S.C. sends to the applicant within a maximum of 5 days, the order of the A.N.R.S.C. president granting the license accompanied by the license and the associated conditions.

If the 30-day deadline for payment of the license granting fee is not met, A.N.R.S.C. will proceed to revoke the license.

In case of refusal to grant the license, A.N.R.S.C. sends to the applicant within a maximum of 5 days from issue, the order of the A.N.R.S.C. president refusing the license accompanied by the reasons for refusal.

In the case where the granting of the license was refused, the applicant may not submit a new licensing documentation earlier than 6 months from the date of issuance of the refusal order.

Final document:

a) Order granting the license, accompanied by the license and the conditions associated with the license;

b) Order refusing the license, accompanied by the reasons for the refusal;

c) Notification regarding the cancellation of the application from the procedure.

Notification deadline upon expiry of the resolution period: 5 days from the date of confirmation of payment of the license granting fee, in case of granting the license, or 5 days from the date of issue of the order refusing the license.

Procedure description : The documents submitted by the applicant for the granting of the license for a public utility service/activity are analyzed by A.N.R.S.C., and in if necessary, the regulatory authority sends the applicant a letter informing them of the obligation to make additions, corrections or clarifications, regarding the request and the documents submitted, within 30 days from the registration of the documentation.

If , within 30 days from the date of the request for additions, the applicant does not provide all the required documentation stipulated by the regulation, including the requested additions, A.N.R.S.C. will return to the applicant the related documentation, deleting the respective request from the licensing procedure, communicating this decision to the applicant.

Depending on the presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) summoning, at the headquarters of A.N.R.S.C., the authorized representatives of the applicant to clarify certain aspects that result/do not result from the provided documentation;

b) on-site verification of the accuracy of the data from the documentation submitted by the applicant.

A.N.R.S.C., through the specialized department, drafts a specialized report that includes the justified proposal for granting/rejection of the license and this will be presented for analysis to the Licensing Commission, by the secretary of the commission.

The proposal for granting/rejection of the license is subject to a vote by the Licensing Commission.

The granting/rejection of the license is done by order of the president of A.N.R.S.C..

In case of granting the license, A.N.R.S.C. informs the applicant of the invoice regarding the licensing fee, which must be paid within a maximum of 30 days from the date of invoice communication.

After confirmation of payment, A.N.R.S.C. sends the applicant, within maximum 5 days, the order of the president of A.N.R.S.C. for granting the license, accompanied by the license and its associated conditions.

In case of non-compliance with the 30-day deadline for paying the licensing fee, A.N.R.S.C. will proceed to withdraw the license.

In the case of refusal to grant the license, A.N.R.S.C. sends the applicant, within a maximum of 5 days from issuance, the order of the president of A.N.R.S.C. for rejection of the license, accompanied by the reasons for refusal.

In the situation where the granting of the license was rejected, the applicant may not submit new licensing documentation earlier than 6 months from the date of issuance of the rejection order.

Final document:

a) Order of granting the license, accompanied by the license and its associated conditions;

b) Order of rejection of the license, together with the reasons for refusal;

c) Notification regarding the deletion of the application from the procedure.

Deadline for Notification upon the expiration of the resolution deadline: 5 days from the date of confirmation of the license granting fee payment, in case of granting, or 5 days from the date of issuing the rejection order.

Procedure description: The documents submitted by the applicant for the granting of the license for a public utility service/activity are analyzed by A.N.R.S.C., and in the event that it is necessary, the regulatory authority sends the applicant an address informing them of the obligation to make supplements, corrections or clarifications, referring to the application and the documents submitted, within 30 days from the registration of the documentation.

In the event that, within 30 days from the date of the supplement request address, the applicant does not provide all the corresponding documentation required by the regulation, including the requested supplements, A.N.R.S.C. will return the related documentation, removing the respective request from the license granting procedure, communicating this decision to the applicant.

Depending on the manner of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) summoning, at the A.N.R.S.C. headquarters, the authorized representatives of the applicant to clarify certain aspects that arise/do not arise from the documentation provided;
