This procedure regulates the method of issuing the certificate of urbanism for construction/demolition/drafting PUZ, PUD within the City Hall of Cruset commune.

Clarifications

Art. 19, para. (2) of the Methodological Norms for the application of Law no.50/1991, approved by MDRL Order no. 839/2009 establishes that the certificate of urbanism is an informative document regarding the legal, economic and technical status of the property, as well as the specific urban planning requirements of the site, determined in accordance with the provisions of approved and endorsed urban planning documents, a document that is issued, upon request, to any applicant - natural or legal person - without the need to present the property title or any other document attesting ownership.

The issuer is prohibited from conditioning the issuance of the certificate of urbanism on the prior elaboration of an urban planning documentation for the property in question, as well as any other technical documentation to define the purpose of the request.

Under these conditions, for the purpose of detailing the proposed urban intervention, other documents prepared by a designer may also be attached to the mandatory legal documentation, consisting of plans on cadastral support with the situation of existing and proposed constructions and a technical memo in which the plan proposals are described in detail, with the estimation of the impact of the proposed works on the neighborhood; These plans are optional and are exclusively for information regarding the investor's intentions, and cannot be endorsed as final;

The plans to be endorsed as final will be extracts of cadastral plans on orthophotoplan or other plans issued / endorsed by the Gorj Office of Cadastre and Real Estate Publicity, highlighting the cadastral parcels for which the certificate of urbanism is requested.

In the case of properties registered in the cadastre and real estate publicity records, the zoning plans, at one of the scales 1:10,000, 1:5,000, 1:2,000, 1:1,000, 1:500, as the case may be, issued upon request by the office of cadastre and real estate publicity (OCPI), may be endorsed as annexes to the certificate of urbanism, provided they highlight the cadastral parcels for which the certificate of urbanism is requested, without containing any proposals regarding construction interventions at parcel level. These endorsed plans may be used within the documentation required for obtaining the approvals requested through the certificate of urbanism.

The boards containing intervention proposals, required by the authorities empowered to issue the necessary endorsements, will be drafted on the topographic support endorsed by OCPI to be used for obtaining the building permit, together with the plans endorsed as final annexed to the certificate of urbanism, mentioned in the previous paragraph.

In accordance with para.23^1, para.23^2, para.23^3, of art.7 of Law no.50/1001 regarding the authorization of construction works, the beneficiary is obliged to present:
- the land registry extract showing the entry of the building permit;
- the announcement made public in a widely circulated newspaper regarding the issued building permit.
Regarding the public nature, the content of the building permit will be subject to study at the headquarters of the public authority issuing the act. (according to para.23^5 art.7 of Law 50/1991 - regarding the authorization of construction works).
