The application is submitted by applicants which can be commercial companies, agricultural companies and other forms of association in agriculture, associations and foundations, agricultural cooperatives, any other legal form of association, according to the applicable legislation, to MADR/MMAP, through DAJ/Forest Guard, for the verification of compliance based on the criteria for producer groups in Annex 2, accompanied by the following documents: a. the application requesting recognition as a producer group/according to the form provided in Annex no. 3 b. a copy of the decision/resolution of the management body/general assembly c. a copy of the articles of incorporation and/or the statute showing that the criteria of Government Ordinance no. 37/2005 are met d. proof of producer status for agricultural producers, as follows - individual members present the producer's certificate, issued in accordance with the provisions of Law no. 145/2014 - members who are authorized individuals, individual enterprises, and family enterprises established according to GEO no. 44/2008, and members which are legal entities, shall submit a copy of the registration certificate with the trade registry/tax registration certificate, as appropriate e. in the case of agricultural producers that are legal entities, documents are submitted showing that they have qualified personnel according to the group(s) of products for which it is to be recognized or should provide in the articles of incorporation that in the first year after recognition it will have such personnel or will contract specialty services f. in the case of forestry producers, the entity submits any document showing its activity in the forestry domain and proves professional training in the field, and the members of this entity own forest land g. the list of member holders, drawn up according to the form provided in Annex no. 4, approved by the general assembly/management body, depending on the provisions of the articles of incorporation - the details related to the production material base, specified in Annex no. 4, must include the size of the areas and type of crops, in the case of crop farms, or the size of the livestock, in the case of livestock farms, showing that the producer group/producer organization seeking recognition can achieve a minimum value of marketed production (VPC), in accordance with the provisions of Government Ordinance no. 37/2005 h. copies of documents attesting qualification of personnel, as applicable i. copies of contracts for specialized technical assistance services or own register with specific technical assistance activities provided by own staff, as applicable j. copies of constitutive acts of member legal entities k. a statutory declaration by members regarding their affiliation to another group or producer organization, in accordance with the provisions of Government Ordinance no. 37/2005 l. a certificate issued in accordance with the provisions of Government Ordinance no. 37/2005, as applicable as an exception to the provisions of EU Regulation no. 1,308/2013, in cases where a member of a producer group/producer organization owns their own production units located in different geographical areas, he/she may be a part of several recognized producer groups/producer organizations for the same group(s) of products or for the same product(s), depending on the location of the production units, if the procedure for justifying this situation as set out in the methodological norms for application of the legislative provisions is observed. Annex no. 2 to Order 358/2016 Annex no. 3 to Order 358/2016 Annex no. 4 to Order 358/2016*

The application shall be submitted by applicants for one or more groups of products or for one or more products from the groups of products mentioned in art.6, para.2 letter a, and letter b - Order 358/2016 commercial companies, agricultural companies, and other forms of association in agriculture, associations and foundations, agricultural cooperatives, any other legal form of association, according to the legislation in force, to MADR/MMAP, through DAJ/Forest Guard, for verifying compliance based on the criteria for producer organizations in Annex 5, accompanied by the following documents: a. the application requesting recognition as a producer organization according to the form provided in Annex no. 3 b. a copy of the decision/resolution of the governing body/general assembly indicating their agreement to undertake legal steps for obtaining recognition c. a copy of the deed of incorporation and/or statute, from which compliance with the criteria in Government Ordinance no. 37/2005 can be determined d. proof of producer status for agricultural producers, as follows - individual members present the producer certificate issued in accordance with Law no. 145/2014 - members who are authorized individuals, individual enterprises, and family enterprises established under GEO no. 44/2008 and member legal entities present a copy of the registration certificate issued by the trade register office/tax registration certificate, as the case may be e. in the case of agricultural producers, the legal entity presents documents showing that they have qualified personnel appropriate to the group of products and/or products for which they are recognized or provide in the deed of incorporation that during the first year from recognition they will have such personnel or that they contract specialized services f. in the case of forestry producers, the entity presents any document from which forestry activity is evident and proves professional training in the field, and members of this entity own forest land g. the list of active members, drawn up according to the form provided in Annex no. 4, approved by the general assembly/governing body, according to the provisions of the constitutive acts; from the mentions regarding the production base, specified in Annex no. 4, the area size and type of crops for plant farms, as well as the livestock size for animal farms, should be indicated, so that it results that the producer group/producer organization to be recognized can achieve a minimum VPC value, according to the provisions of art. 6 para. 2 from Government Ordinance no. 37/2005 h. copies of documents proving staff qualification, as appropriate i. copies of contracts for specialized technical assistance services or the entity's own register with specific technical assistance activities provided through its own personnel, as appropriate j. copies of the governing acts of the member legal entities k. members’ declaration on their own responsibility regarding their membership in another producer group or organization, according to the provisions of art. 6 para. 4 and 5 from Government Ordinance no. 37/2005 l. certificate issued in accordance with the provisions of art. 6 para. 5 from Government Ordinance no. 37/2005, as appropriate by exception to the provisions of EU Regulation no. 1.308/2013, if a member of a producer group/producer organization owns separate production units located in different geographical areas, they may be part of several recognized producer groups/producer organizations for the same group(s) of products, namely the same product(s), depending on the location of the production units if the justification procedure established in the methodological norms for the application of the legislative provisions is followed.*
