Law no. 677/2001—for the protection of individuals regarding the processing of personal data and the free movement of such data—establishes the general rules for processing personal data, the rights of the data subjects, and the obligations of the operators. This law protects the private and family life of citizens.
Personal data represents any information related to an identified or identifiable individual (name and surname, domicile or residence address, date of birth, data from civil status documents, series and no. BI/CI, personal identification number)
Individuals or legal entities may request, based on motivated written requests, the communication of personal data from the National Register of Personal Records, regarding civil status data, identity documents, domiciles and residences, and the assigned personal identification number.
In the case where an individual requests the transmission of personal data through a law office, it is necessary to submit a written request to this effect, which will be submitted for proper resolution to the community public service of personal records within whose jurisdiction the individual whose data is being requested resides.
According to the regulations, providing personal data can be done only after obtaining, in advance, the written consent of the data subjects (by which they expressly and unequivocally declare whether they agree or not with the provision of the requested data).
The consent of the data subjects is not required when there is a justified legal basis.
A justified legal basis is considered to be requests for personal data received from police authorities, the Ministry of Defense, the Romanian Intelligence Service, the Prosecutor’s Office, the Justice authorities, specialized social protection institutions regarding minors or other entitled persons, individuals whose legitimate interests are proven by documents attesting the justified legal basis, individuals requesting the communication of their own personal records data, etc.
