The social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary personal budget for the month in which the death occurred, and, where applicable, the social benefits due and unpaid until death shall be paid to the surviving spouse, children, parents or, in their absence, to other heirs, under common law conditions, upon their request. The amounts provided above may be claimed by the heir at the territorial agency for payments and social inspection within the general limitation period, based on the document attesting the status of heir, as well as, in the case where there are several heirs, the declaration on their own responsibility that the other heirs are not requesting these amounts.
