Registering a patent application at OSIM is not mandatory and is done for a fee, the fee regime being established by Government Ordinance no. 41/1998, regarding taxes in the field of industrial property protection and the regime for their use, with subsequent amendments and completions. The standard form "Patent Application" must be completed in 3 copies accompanied by the relevant documents: abstract, description, drawings (if applicable), claims. These can be submitted on-line, by mail or at OSIM headquarters. The examination of a patent application is carried out in accordance with the provisions of Law 64/1991 regarding patents, with subsequent amendments and completions, as well as the Implementing Regulation, provided that the legal fees are paid. Public registers can be consulted here, and OSIM decisions are subject to appeal procedures.
