Social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary budget for the month in which the death occurred, and, where applicable, social benefits due and unpaid until death, shall be paid to the surviving spouse, children, parents, or, in their absence, to other heirs, under common law provisions, upon their request. The amounts mentioned above may be requested, at the territorial agency for payments and social inspection, by the heir, within the general prescription period, based on the document certifying the quality of heir, as well as, in the case where there are multiple heirs, a statement on their own responsibility that the other heirs do not request these amounts.
