The purpose of this procedure is to regulate the granting of certain social protection measures for the population, represented by monthly aid to cover part of the expenses related to heating the home during the cold season, as well as the method of invoicing and payment of thermal energy.
The heating aid is granted to families whose members are Romanian citizens, as well as to single persons who reside in Romania.
The heating aid is also granted to families and single persons who do not have Romanian citizenship, if they are in one of the following situations:
a) They are citizens of a member state of the European Union, the European Economic Area, the Swiss Confederation or other states, during the period in which they have their domicile or, as the case may be, residence in Romania, under the conditions of the law;
b) They are foreign citizens or stateless persons who have been granted, under the law, a form of protection and have their domicile or, as the case may be, residence in Romania, under the conditions of the law;
c) They are stateless persons who have their domicile or, as the case may be, residence in Romania, under the conditions of the law.
Heating aid is granted to families, or as the case may be, single persons, only for their domicile residence, or, as the case may be, their legal residence.
For the purposes of this procedure, institutions of social assistance or other establishments of a social nature, including those established and administered by religious denominations for monastic purposes, are not considered dwellings.
The heating aids granted under the conditions of this emergency ordinance are not taken into account when determining the right to social aid under Law no. 416/2001, with subsequent amendments and completions, as well as the child support benefits granted under Law no. 277/2010 regarding child support allowance, republished, with subsequent amendments, or legal support obligations, and may not be pursued except for the recovery of amounts granted without justification.
