STANDARD REQUEST for the issuance of the operating permit, in which the following identification elements of the merchant will be included: merchant name, registered office, Unique Registration Code, registration number at the Trade Register Office, representative, address of the location for which the operating permit is requested, the activities that will be carried out at this location, proposed operating hours. This standard request is accompanied by documentation which includes documents established in correlation with the activity to be carried out at the location, in compliance with the relevant legislative provisions.*

The certificate of findings regarding the activities carried out at the work point that is the subject of the request, issued by the Trade Registry Office, includes strict information referring to the work point and lists the activities that are actually carried out at the work point. In the situation where this certificate of findings includes activities that are not actually carried out at the work point and for which the operating permit is not requested, the administrator of the trader shall submit a statement on their own responsibility regarding the activities carried out at the work point.*

The updated land register, not older than 90 days, of the property where the commercial activity or service provision is carried out, with the appropriate function registered. The function registered in the land register must be closely correlated with the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions, according to the current local urban planning regulations. If, in the land register, the space in question is designated as a dwelling or has another destination, different in function from the one for which the operating permit is requested, the urbanism certificate and the approvals/agreements mentioned therein / the building permit, as the case may be, issued by the Urbanism Department for the change of destination/function based on the provisions of the approved urban planning regulations will be submitted, respecting the classification of permitted uses by categories of functions. If the commercial/service activity is to be carried out in a temporary and removable construction, for which there is a building permit, such as a kiosk, booth or stand, or other similar constructions (for commercial activity), located on private property (except those placed on public or private property of the municipality), the updated land register of the land on which it is located, not older than 90 days, will be submitted if it is not possible to present a land register including this construction. An extract from the land register will NOT be submitted in the case of spaces with another destination that are the subject of lease agreements with the local public administration authority.*

Traders who do not own the premises related to the place of business to be authorized will submit, in addition to the documents mentioned in the previous point, any document/contract that regulates the lease in their favor. If this lease regulation document is not for an indefinite period, it is considered that the authorization request is made for a limited period, within the validity of the lease.*

The written consent of the co-owners - co-indivisors (where applicable) shall be given specifying the identification data of the signatories, namely the identity document and the personal numerical code*

The site plan showing the location of the property where the commercial or service activity is carried out: site plans taken from the internet are also valid.*

A photograph of the sales structure facade will be presented, showing the access to it.*

The plan endorsed as unchanged attached to the building permit for the space of the sales structure or the survey of the space in question will be presented.*

It is a standard form that includes information regarding the sales structure.*

It will be presented by the food service units within the accommodation facilities and those managed by tourism commercial companies, regardless of location.*

The fire safety authorization or denial issued by the competent authority, the “Avram Iancu” Emergency Situations Inspectorate of Cluj County.*

Declaration on own responsibility regarding the exact number of seats at the tables, respectively the total number of people that can be accommodated within the premises of the sales structure in question. It will be formulated on own responsibility by the representative of the merchant.*

Declaration regarding the classification by type of the public food unit in the situation of public food service activities: the declaration provided in annex no. 2 to Government Decision no. 843/1999 shall be completed.*

Environmental permit issued by the Cluj Environmental Agency for the activities included in annex 4 to HCL 851/2017 (see normative acts)*

Certification of compliance with hygiene and public health regulations, issued by the Cluj Public Health Directorate, for the activities included in annex 5 to HCL 851/2017 (see normative acts)*

The document issued by the Sanitary-Veterinary Directorate of Cluj County for the activities included in annex 6 to HCL 851/2017 (see normative acts)*

The certificate of completion of hygiene courses or the diploma of graduation from a high school with an economic profile will be presented, for the employed personnel.*

The sanitation contract concluded with the sanitation company serving the respective area will be presented.*

One of these documents will be presented for the sales structure being authorized.*

Merchants who carry out public catering activities (NACE codes 561 and 563) or recreational and entertainment activities (NACE code 932) at the sales structure and request operating hours after 10:00 PM, must also present, in this regard, the approval from Cluj-Napoca Municipal Police to operate according to the requested schedule, based on the applicable legislation.*

A copy of the building permit/subscription for the occupation of public domain with access ways, valid at the time, will be presented in cases where access to the sales structure subject to authorization is made through distinct arrangements built on public domain, other than those corresponding to public alleys. If the sales structure does not have an access way, a declaration on one's own responsibility by the merchant will be submitted.*
