The operating permit issued under the conditions of this procedure allows merchants, natural or legal persons authorized according to the law, to carry out public catering activities and recreational and entertainment activities. These activities are carried out with reference to the public catering activities and recreational and entertainment activities provided in the annex to Government Ordinance no. 99/2000 regarding the marketing of products and market services, republished, as well as in other relevant regulatory acts.
In order to obtain the operating permit, the merchant will address the City Hall of Cluj-Napoca by submitting an application Form C - STANDARD APPLICATION for issuing the operating permit, in which both the merchant's identification elements: merchant name, registered office, company identification number (CUI), registration number at the Trade Register Office, representative, as well as the address of the working point for which the operating permit is requested, the activities to be carried out at this working point, and the proposed operating hours will be entered.
This standard application is accompanied by documentation that includes documents established in correlation with the activity/activities to be carried out at the work point, in compliance with the applicable legislative provisions. The structure that deals with the application is the Municipality's Patrimony and Property Registration Directorate, Trade Authorization Service.

The function registered in the land register must be closely correlated with the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions, according to the current local urban planning regulations. If, in the land register, the space in question is designated as a dwelling or has another destination, different in function from the one for which the operating permit is requested, the urbanism certificate and the approvals/agreements mentioned therein / the building permit, as the case may be, issued by the Urbanism Department for the change of destination/function based on the provisions of the approved urban planning regulations will be submitted, respecting the classification of permitted uses by categories of functions. If the commercial/service activity is to be carried out in a temporary and removable construction, for which there is a building permit, such as a kiosk, booth or stand, or other similar constructions (for commercial activity), located on private property (except those placed on public or private property of the municipality), the updated land register of the land on which it is located, not older than 90 days, will be submitted if it is not possible to present a land register including this construction. An extract from the land register will NOT be submitted in the case of spaces with another destination that are the subject of lease agreements with the local public administration authority.*
