The social benefits remaining uncollected by the deceased person with disabilities, representing the indemnity and/or the personal complementary budget for the month in which the death occurred, and, if applicable, the social benefits due and unpaid until the time of death, shall be paid to the surviving spouse, children, parents or, in their absence, to the other heirs, according to common law, at their request. The amounts mentioned above may be requested from the territorial agency for payments and social inspection by the heir, within the general statute of limitations, based on the document attesting the capacity of heir, as well as, if there are multiple heirs, a declaration on their own responsibility that the other heirs are not requesting these amounts.
