The filing of a trademark application and a geographical indication with OSIM is not mandatory and is subject to a fee, the fee regime being established by Government Ordinance no.41/1998, regarding fees in the field of industrial property protection and their usage regime, as subsequently amended and supplemented. The standard forms “Application for national trademark registration” or “Application for registration of a geographical indication” must be filled in 2 copies accompanied by proof of payment of the related fees. These can be submitted online by following the link https://www.osim.ro/depuneri-online-marci, by mail or at the OSIM headquarters. The examination of a national trademark or geographical indication registration application is carried out in accordance with the provisions of Law 84/1998 regarding trademarks and geographical indications, republished, as well as the Implementing Regulation.
