Before addressing the competent administrative court, the person who considers themselves injured in a right or a legitimate interest by a unilateral administrative act must request the issuing public authority, within 30 days from the date the act was communicated, to revoke it, in whole or in part. The complaint can be addressed equally to the hierarchical superior body, if it exists.

A person injured in a right recognized by law or in a legitimate interest, by a unilateral administrative act, dissatisfied with the response received to the prior complaint addressed to the issuing public authority or if they have not received any response within the term provided in art. 7 para. (4), may notify the competent administrative court to request the annulment, in whole or in part, of the act, compensation for the damage caused and, if applicable, compensation for moral damages. Also, the person who considers themselves injured in a right recognized by law by failure to resolve the request within the term or by unjustified refusal to resolve the request, may address the administrative court.
