Document issued by the Trade Register Office upon the registration of the trader*

The certificate regarding the activities carried out at the work point that is the subject of the request, issued by the Trade Register Office, contains strict information regarding the work point and lists the activities actually carried out at the work point. In the situation where this certificate includes activities that are not actually carried out at the work point and for which an operating permit is not requested, the merchant's administrator will submit a declaration made under his own responsibility regarding the activities carried out at the work point.*

The updated land register, no older than 90 days, of the property where the commercial activity or services are carried out, indicating the appropriate function. The function registered in the land register must be closely correlated with the provisions of the approved urban planning regulations, complying with the classification of permitted uses by categories of functions, according to the applicable Local Urban Planning Regulation. If the land register indicates the space as a dwelling or with another destination, different as a function from that for which the operating permit is requested, the urbanism certificate and the approvals/agreements mentioned therein / the building permit, as the case may be, issued by the Urbanism Department for the change of destination/function based on the provisions of the approved urban planning regulations, must be presented, complying with the classification of permitted uses by categories of functions. If the commercial/service activity is to take place in a provisional and removable construction, for which a building permit exists, such as a kiosk, booth, or stall or other similar units (for commercial activity), located on private property (except those placed on public or municipality's private domain), the updated land register of the land plot on which it is located must be presented, no older than 90 days, if it is not possible to present a land register extract with the registration of this construction. The CF extract will NOT be presented in the case of premises with another destination that are the subject of lease agreements with the local public administration authority.*

Traders who do not own the space related to the work point they wish to authorize shall include in their file, in addition to the documents mentioned in the previous point, any deed/contract by which the lease is regulated in their favor. If this lease regulation deed is not for an indefinite period, the authorization request shall be considered as made for a limited period, within the validity of the lease.*

The written agreement of the co-owners - co-indivisors (where applicable) will be given specifying the identification data of the signatories, respectively the identity document and personal numeric code*

The site plan showing the zoning of the property where the commercial or service activity takes place: site plans taken from the internet are also valid.*

A photograph of the facade of the sales structure will be presented, showing the access to it.*

The plan intended to remain unchanged will be presented as an annex to the building permit for the sales structure space or the survey of the space in question.*

It is a standard form that includes information regarding the sales structure.*

The fire safety authorization or denial issued by the competent authority "Avram Iancu" Emergency Situations Inspectorate of Cluj County.*

Environmental permit issued by the Cluj Environmental Agency for the activities included in annex 4 to HCL 851/2017 (see normative acts)*

Certification of compliance with hygiene and public health standards, issued by the Cluj Public Health Directorate, for the activities included in annex 5 to HCL 851/2017 (see normative acts)*

The document issued by the Sanitary-Veterinary Directorate of Cluj County for the activities included in annex 6 to HCL 851/2017 (see normative acts)*

The certificate of completion of hygiene courses or the diploma of graduation from a high school with an economic profile shall be presented for the employed staff.*

The sanitation contract concluded with the sanitation company serving the respective area will be presented.*

One of these documents will be presented for the sales structure being authorized.*

A copy of the building permit/subscription for occupying public domain with access roads, valid, will be presented in situations where access to the sales structure subject to authorization is made through distinct arrangements on the public domain, other than those corresponding to public alleys. If the sales structure does not have an access road, a statement made on the trader's own responsibility will be submitted.*

STANDARD APPLICATION for issuing the operating permit in which the following identification elements of the trader will be entered: trader name, registered office, Unique Identification Code (CUI), registration number at the Trade Register Office, representative, address of the work point for which the operating permit is requested, activities to be carried out at this work point, proposed operating hours. This standard application is accompanied by documentation comprising documents established in correlation with the activity to be carried out at the work point, in compliance with applicable legislative provisions.*
