Processing time: 60 days from the registration of the documentation or 30 days from the transmission by the public utility services operator of the completions requested by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the purpose of granting the license for a public utility service/activity are analyzed by A.N.R.S.C., and in case it is necessary, the regulatory authority sends to the applicant a letter informing them of the obligation to make additions, corrections or clarifications, with reference to the request and the documents submitted, within 30 days from the registration of the documentation.

In case, within 30 days from the date of the request letter for additions, the applicant does not provide all the appropriate documentation provided by the regulation, including the requested additions, A.N.R.S.C. will return the related documentation, deleting the respective request from the license granting procedure, informing the applicant of this decision.

Depending on the presentation method and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) calling, at the A.N.R.S.C. headquarters, the authorized representatives of the applicant, to clarify certain aspects that result/do not result from the documentation provided;

b) on-site verification of the accuracy of the data in the documentation submitted by the applicant.

A.N.R.S.C., through the specialty department, draws up a specialty report which includes the justified proposal for granting/rejecting the license and which will be presented for analysis to the Licensing Commission, by the Secretary of the Commission.

The proposal for granting/rejecting the license is subject to a vote within the Licensing Commission.

The granting/rejection of the license is done by order of the President of A.N.R.S.C.

In the case of granting the license, A.N.R.S.C. communicates to the applicant the tax invoice for the license granting fee, which must be paid within a maximum of 30 days from the date of invoice communication.

After confirming the payment, A.N.R.S.C. sends the applicant, within a maximum of 5 days, the order of the President of A.N.R.S.C. granting the license, accompanied by the license and its associated conditions.

In case of non-compliance with the 30-day term for payment of the license granting fee, A.N.R.S.C. will proceed to withdraw the license.

In the case of refusal to grant the license, A.N.R.S.C. sends the applicant, within a maximum of 5 days from issuance, the order of the President of A.N.R.S.C. rejecting the license, accompanied by the reasons for refusal.

For the situation in which the granting of the license has been refused, the applicant can no longer submit new licensing documentation earlier than 6 months from the date of issuance of the rejection order.

Final document:

a) Order for granting the license, accompanied by the license and the associated conditions;

b) Order for rejecting the license, accompanied by the reasons for refusal;

c) Notification regarding the removal of the request from the procedure.

Notification term upon expiration of the processing period: 5 days from the date of payment confirmation of the license granting fee, in case of granting the license, respectively 5 days from the date of issuance of the license rejection order.
