Social benefits not collected by the deceased person with disabilities, representing the indemnity and/or the complementary budget for the month in which the beneficiary's death occurred, and, as the case may be, the social benefits due and not collected up to the date of death which are paid to the surviving spouse, children, parents or, in their absence, to other legal heirs, according to common law, upon their request.
The amounts provided above may be requested at the territorial agency for payments and social inspection, by the heir, within the general statute of limitations, based on documents attesting the status of heir.
