The operating permit issued under the conditions of this procedure allows merchants, natural or legal persons authorized according to the law, to carry out wholesale trade activities. These activities are exercised with reference to the food and non-food products stipulated in the annex to Government Ordinance no. 99/2000 regarding the marketing of products and market services, republished, as well as other applicable regulatory acts.
For obtaining the operating permit, the merchant shall address the Cluj-Napoca City Hall by submitting an application—Form B - STANDARD APPLICATION for issuing the operating permit, in which both the identification elements of the merchant will be entered: merchant name, registered office, Unique Registration Code (CUI), registration number with the Trade Register Office, representative, as well as the address of the work point for which the operating permit is requested, the activities to be carried out at this work point, and the proposed operating schedule. This standard application is accompanied by documentation comprising documents established in correlation with the activity to be carried out at the work point, in compliance with the applicable legislative provisions. The structure handling the application is the Directorate for Municipal Heritage and Property Records, Commercial Authorization Service.

The function registered in the land register shall be closely correlated with the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions, according to the local urbanism regulations in force. In the event that, in the land register, the space in question is designated as a residence or has another purpose, but with a function different from the one for which the operating permit is requested, the urbanism certificate and the approvals/agreements mentioned therein / building permit, as the case may be, issued by the Urbanism Directorate for the change of use/function shall be presented, based on the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions. In the case where the commercial/service activity is to be carried out in a temporary and removable construction, for which there is a building permit, such as a kiosk, booth, or stand or other similar structures (for commercial activity), located on private property (except those placed on the public or private domain of the municipality), the updated land register of the land on which it is located, not older than 90 days, shall be presented, if it is not possible to present a land register with the registration of this construction. An extract from the Land Register will NOT be presented in the case of spaces with another destination that are the subject of lease contracts with the local public administration authority.*
