The authorization of the mediator is carried out based on the individual application addressed to the Council, with the fulfillment of the conditions provided by Law 192/2006 regarding mediation and the organization of the mediator profession. A person who cumulatively meets the following conditions may become a mediator: a) has full legal capacity; b) has higher education; c) has at least 3 years of work experience; d) is medically fit to perform this activity; e) enjoys a good reputation and has not been finally convicted for committing an offense that would harm the prestige of the profession; f) has completed mediator training courses, under the law, or a postgraduate master's program in the field, accredited according to the law and approved by the Mediation Council.

The issued act may be contested at the Bucharest Court of Appeal – Administrative and Fiscal Litigation Section, after completion of the preliminary procedure provided by Law 554/2004, on administrative and fiscal litigation.
