Request for license for the public sanitation service of localities or for one or more specific activities of this service, provided under the form of direct management by public services of local or county interest, with legal personality, established and organized by decisions of the deliberative authorities of the administrative-territorial units - https://www.anrsc.ro/gestiune-directa-salubrizare/
Processing time: 60 days from the registration of the documentation or 30 days from the submission by the public utility services operator of the requested completions by A.N.R.S.C.
Procedure description: The documents submitted by the applicant in order to be granted a license for a public utility service/activity are analyzed by A.N.R.S.C., and in case it is necessary, the regulatory authority sends the applicant a notice informing about the obligation to make additions, corrections, or clarifications regarding the application and the documents submitted, within 30 days from the registration of the documentation.
In the event that, within 30 days from the date of the notice requesting additions, the applicant does not provide all the necessary documentation as required by the regulation, including the requested additions, A.N.R.S.C. will return the relevant documentation, deleting the respective application from the licensing procedure, communicating this decision to the applicant.
Depending on the manner of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:
a) summon, at the A.N.R.S.C. headquarters, the authorized representatives of the applicant, to clarify certain aspects that result/do not result from the documentation provided;
b) perform on-site verification of the accuracy of the data in the documentation submitted by the applicant.
A.N.R.S.C., through the specialized department, prepares a specialty report that includes the justified proposal to grant/reject the license, which will be presented for analysis to the Licensing Commission, by the secretary of the commission.
The proposal to grant/reject the license is put to the vote in the Licensing Commission.
The granting/rejection of the license is done by order of the president of A.N.R.S.C..
In the case of granting the license, A.N.R.S.C. communicates to the applicant the invoice for the license granting fee, which must be paid within maximum 30 days from the date of invoice communication.
After payment confirmation, A.N.R.S.C. sends the applicant, within maximum 5 days, the order of the A.N.R.S.C. president for granting the license, accompanied by the license and the associated conditions.
In case of non-compliance with the 30 days deadline for payment of the license granting fee, A.N.R.S.C. will proceed to withdraw the license.
In case of refusal to grant the license, A.N.R.S.C. sends the applicant, within maximum 5 days from issuance, the order of the A.N.R.S.C. president for rejection of the license, accompanied by the reasons for refusing the granting.
In the situation where the granting of the license has been rejected, the applicant may not submit a new licensing documentation earlier than 6 months from the date of issuance of the rejection order.
Final document:
a) Order for granting the license, accompanied by the license and the associated license conditions;
b) Order for rejection of the license, accompanied by the reasons for refusal of granting;
c) Notice regarding the removal of the application from the procedure.
Notification deadline upon the expiration of the resolution term: 5 days from the date of confirmation of payment of the license granting fee, in the case of granting the license, respectively 5 days from the date of the issuance of the order rejecting the license.
