Social benefits that have not been collected by the deceased person with disabilities, representing the allowance and/or the personal complementary budget for the month in which the death occurred, and, as the case may be, the social benefits due and unpaid up to the time of death, shall be paid to the surviving spouse, children, parents or, in their absence, to the other heirs, under the common law, upon their request. The sums mentioned above may be claimed at the territorial agency for payments and social inspection by the heir, within the general statute of limitations, based on the document certifying the status of heir, as well as, in the case where there are several heirs, a declaration on their own responsibility that the other heirs do not request these sums.
