The sale of land located outside the built-up areas of communes/towns/municipalities according to Law 17/2014*

The implementing rules of Law 17/2014 regarding the sale of land located in the outskirts of communes/towns/municipalities provide for 2 procedural stages, as well as the classification of potential buyers into preemptors of various ranks, from 1 to 7.
- Preemptors of rank I: co-owners, first-degree relatives, spouses, relatives and in-laws up to and including the third degree;
- Preemptors of rank II: owners of agricultural investments for tree crops, vineyards, hops, exclusively private irrigation and/or lessees. If agricultural investments for tree crops, vineyards, hops, and irrigation are present on the lands for sale, the owners of these investments have priority to purchase these lands;
- Preemptors of rank III: owners and/or lessees of the agricultural lands neighboring the land for sale;
- Preemptors of rank IV: young farmers;
- Preemptors of rank V: The "Gheorghe Ionescu-Şişeşti" Academy of Agricultural and Forestry Sciences and research and development units in the fields of agriculture, forestry, and the food industry, organized and regulated by Law no. 45/2009 on the organization and functioning of the "Gheorghe Ionescu-Şişeşti" Academy of Agricultural and Forestry Sciences and the research-development system in the fields of agriculture, forestry, and the food industry, with subsequent amendments and completions, as well as educational institutions with an agricultural profile, for the purpose of buying agricultural lands located in extravilan with the strict destination necessary for agricultural research, located in the vicinity of the lots already in their patrimony;
- Preemptors of rank VI: natural persons with domicile/residence located in the administrative-territorial units where the land is located or in neighboring administrative-territorial units;
- Preemptors of rank VII: the Romanian state, through the State Domain Agency, hereinafter referred to as S.D.A.;
The first stage consists of a period of 45 working days, as well as the publication of the SALE OFFER, which includes the identification details of the land (field, parcel, cadastral number, its price), at the headquarters of the local administrative unit (UAT) within whose range the land is located, on its website and on the website of the Directorate for Agriculture. If during the 45 working days no preemptor expresses the intention to purchase the land in question, by submitting to the UAT headquarters a NOTICE OF ACCEPTANCE OF THE SALE OFFER, a MINUTES OF ASCERTAINMENT OF THE CONDUCT OF THE PROCEDURAL STAGE REGARDING THE EXERCISE OF THE RIGHT OF PREEMPTION is drawn up, thus entering the second procedural stage.
The second procedural stage consists of a period of 30 calendar days during which potential buyers lose the right of preemption but can still submit REQUESTS FOR REGISTRATION OF THE PURCHASE OFFER FOR NATURAL/LEGAL PERSONS. If during these 30 days no such requests are submitted to the UAT headquarters, a MINUTES OF COMPLETION OF THE PROCEDURE is drawn up.
