Authorization of judicial technical experts by examination*

The person who meets the following conditions may attend the exam for acquiring the status of judicial technical expert:

a) is a Romanian citizen, a citizen of a European Union member state, belonging to the European Economic Area, or a citizen of the Swiss Confederation;

b) knows the Romanian language;

c) has full exercise capacity;

d) has graduated higher education in the specialty for which they are presenting at the judicial technical expert exam, proven by diploma;

e) has at least 3 years of experience in the specialty in which they obtained the diploma;

f) is medically fit for carrying out expert activity;

g) does not have a criminal record and enjoys a good professional and social reputation.

The announcement regarding the organization of the exam, the exam syllabus, and the exam date is published on the Ministry of Justice's website (https://www.just.ro/despre-noi/cariera/) at least 60 days before the date of the exam. Also, the announcement and syllabus are displayed at the headquarters of local offices for judicial, technical, and accounting expertise within the tribunals, in a visible and accessible place to the public, a report is prepared on this, which is immediately sent to the Ministry of Justice and published on the websites of the courts of appeal.

The announcement regarding the organization of the exam includes information on the specialization(s) for which the exam is organized, the exam schedule, the location where the exam will be held, the period and methods of registration, the contents of the registration file, and the amount and payment methods of the registration fee.

The registration fee for the exam, the amount of which will be established by order of the Minister of Justice, is paid at the cashier's office of the Ministry of Justice or to the Ministry of Justice's bank account, IBAN RO86 TREZ 7002 0E33 0500 XXXX, opened at the Operational Treasury of Bucharest Municipality; Beneficiary: Ministry of Justice; fiscal code: 4265841.

This procedure will be operationalized throughout the registration period for the exam, which will be approved by the Minister of Justice.​

The application for enrollment will be drafted in Romanian and will include information about the applicant: name and surname, personal identification number, citizenship, domicile address in the EU or EEA member state and, if applicable, residence address, telephone, fax, email. The application will specify the examination session and the specialization for which the candidate is applying. Registration for the exam must be made at least 30 days before the exam date, after the announcement is published on the Ministry of Justice website (https://www.just.ro/despre-noi/cariera/). The candidate shall submit the criminal record certificate, either in original or in copy, which is within the validity period, or the candidate’s express consent given through a written declaration for the Ministry of Justice to obtain the criminal record extract, according to the law. If the criminal record certificate is issued in a language other than Romanian, a copy of the translation of the respective document into Romanian must also be submitted, performed by a translator authorized by the Ministry of Justice.*

Appeal procedure: The Regulation on the conduct of the examination and interview for the assignment of the status of judicial technical expert and the professional testing of specialists who carry out judicial technical expertise, approved by Order of the Minister of Justice no. 2059/C/2025, does not provide for the possibility to appeal the results of the verification of the fulfillment of the conditions for registration for the examination.​

Art. 11 para. (9) of the Regulation on the conduct of the examination and interview for the assignment of the status of judicial technical expert and the professional testing of specialists who carry out judicial technical expertise, approved by Order of the Minister of Justice no. 2059/C/2025, provides the following: “Within one working day from the date of publication of the list with the exam results, candidates dissatisfied with their grade may submit an appeal, under penalty of forfeiture, which is filed at the headquarters of the Ministry of Justice, within the working hours of the “Registry” department, or by electronic means, at the email address indicated by the Ministry of Justice. The deadline starts running from zero o'clock on the working day following the one on which the list with the exam results was published, and ends at 24:00 of that day.”
