Request for issuance/extension of operating permit for commercial activity (Markets/Bazaars)*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of art.5 para.(1) of OG no.99/2000 regarding the commercialization of market products and services, any commercial activity is carried out only by authorized merchants under the conditions of the law, and according to art.6 para.(1) and (2) of the same normative act: commerce in public areas is carried out in fixed or ambulant sales structures. The exercise of commercialization activities in public areas is subject to the approval of the local public administration authorities or the sectors of Bucharest Municipality, as appropriate, in compliance with their own regulations and urban planning plans.

Considering the aforementioned legal provisions, reported to the provisions of art.63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and additions, the Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulation regarding the carrying out of activities for the commercialization of market products and services on the territory of Sector 3 of the Municipality of Bucharest.

The regulation establishes the procedure for obtaining the agreement/authorization/operating permit by natural and legal persons who conduct commercialization activities of market products and services in public areas or in any other type of area intended for public use, in fixed or ambulant sales structures, permanent, temporary or, as applicable, seasonal on the territory of Sector 3 of the Municipality of Bucharest.

According to art.2 letter a), the operating agreement is the individual administrative act by which the conditions for carrying out activities for the commercialization of market products and services are established, exclusively food service units; letter b) the operating authorization is the individual administrative act by which the conditions for carrying out food service activities (restaurant CAEN code 5610, bar CAEN code 5630) are established, and according to letter c), the operating permit is the individual administrative act by which the conditions for carrying out activities for the commercialization of market products and services, carried out temporarily and/or seasonally, are established.

According to art.3 of H.C.L.S.3 no. 313/2017: economic agents who carry out or are about to carry out commercial activities, service provision and public food service activities, are obliged to submit the documentation for obtaining or extending the validity of the operating agreement/authorization at least 30 calendar days before the date of commencement of the activity to be carried out or before the expiration date of the initially authorized validity.

The fee for issuing and releasing the operating permit/agreement/authorization, as well as the annual approval fee, are provided in the Decision of the General Council of the Municipality of Bucharest regarding the establishment of the levels of taxes and local fees in the Municipality of Bucharest. These will be paid at the cash desks within the City Hall of Sector 3, and proof of payment will be submitted together with the authorization documentation.

In accordance with the provisions of art. 475 para. (3), (4) and (5) of Law no. 227/2015 regarding the Fiscal Code of Romania, with subsequent amendments and additions and the Decisions of the General Council of the Municipality of Bucharest regarding the establishment of the levels of taxes and local fees in the Municipality of Bucharest, economic agents who carry out public food service activities (CAEN code 5610,5630) must pay the public food service tax in full, in advance of the issuance of the authorization, regardless of the period remaining until the end of the respective fiscal year, as follows:

- fee in the amount of 3,000 lei for the issuance/annual approval of the Operating Authorization - public food service (bar, restaurant), for an area up to 500 m2;
- fee in the amount of 4,000 lei for the issuance/annual approval of the Operating Authorization - public food service (bar, restaurant), for an area greater than 500 m2.

Request for issuance/extension of the operating permit for commercial activity at stalls/spaces in markets/bazaars for SC*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of art.5 para.(1) of Government Ordinance no.99/2000 regarding the commercialization of products and market services, any commercial activity is carried out only by authorized merchants under the conditions of the law, and according to art.6 para.(1) and (2) of the same normative act: commerce in public areas is carried out in fixed or mobile sales structures. Considering the aforementioned legal provisions, related to the provisions of art.63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and completions, the Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulation regarding the carrying out of activities for commercialization of products and market services on the territory of Sector 3 of Bucharest Municipality.

According to art.3 of H.C.L.S.3 no. 313/2017: economic agents who carry out or are to carry out commercial activities, service provision, and public food service, are obliged to submit documentation for obtaining or extending the validity period of the operating agreement/authorization, at least 30 calendar days before the date of starting the activity they are to carry out or before the date of expiration of the initially authorized validity.

The fee for issuing and releasing the operating permit/agreement/authorization, as well as the fee for its annual endorsement, are provided in the Decision of the General Council of Bucharest Municipality regarding the establishment of the levels of local taxes and fees in Bucharest Municipality. These shall be paid at the Sector 3 City Hall cashier's desks, and proof of payment shall be submitted along with the authorization documentation.

In accordance with the provisions of art. 475 para. (3), (4) and (5) of Law no. 227/2015 regarding the Fiscal Code of Romania, with subsequent amendments and completions, and the Decisions of the General Council of Bucharest Municipality regarding the establishment of the levels of local taxes and fees in Bucharest Municipality, economic agents carrying out public food service activities (CAEN code 5610,5630) must pay the public food service fee in full, in advance of the issuance of the authorization, regardless of the remaining period until the end of the respective fiscal year, as follows:

Request for the issuance of the operating permit for seasonal terraces (NACE code 5630, 5610)*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of art.5 para.(1) of Government Ordinance no.99/2000 regarding the commercialization of goods and market services, any commercial activity is carried out only by authorized merchants under the law. According to art.6 para.(1) and (2) of the same normative act: trade in public areas is carried out in sales structures with a fixed or mobile headquarters. The activity of commercialization in public areas is subject to the approval of the authorities of the local public administrations or the sectors of Bucharest Municipality, as the case may be, with respect to their own regulations and urban planning.

Taking into account the aforementioned legal provisions, related to the provisions of art.63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, with subsequent amendments and additions, the Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulation regarding the conduct of activities of commercialization of goods and market services on the territory of Sector 3 of Bucharest Municipality.

The regulation establishes the procedure for obtaining the operating agreement/authorization/approval by individuals and legal entities who carry out activities of commercialization of goods and market services in public areas or any other area intended for public use, in sales structures with a fixed or mobile headquarters, permanent, temporary or, as the case may be, seasonal on the territory of Sector 3 of Bucharest Municipality.

According to art.2 letter a), operating agreement is the individual administrative act by which conditions are established for carrying out commercialization activities of goods and market services, excluding public food units; letter b) operating authorization is the individual administrative act by which conditions are established for carrying out public food activities (restaurant CAEN Code 5610, bar CAEN Code 5630), and according to letter c), operating approval is the individual administrative act by which conditions are established for carrying out temporary and/or seasonal commercialization activities of goods and market services.

According to art.3 of H.C.L.S.3 no. 313/2017: economic agents who conduct or intend to conduct commercial, service, and public food activities are required to submit documentation for obtaining or extending the validity period of the operating agreement/authorization, at least 30 calendar days before the date of commencement of the activity to be carried out or before the expiry date of the initially authorized validity.

The fee for issuing and releasing the approval/agreement/operation authorization, as well as the fee for its annual endorsement are provided in the Decision of the General Council of Bucharest Municipality regarding the establishment of levels of local taxes and fees in Bucharest Municipality. These will be paid at the Sector 3 City Hall cash desks, and proof of payment shall be submitted with the authorization documentation.

In accordance with the provisions of art. 475 para. Request for extension of the operating license – public catering CAEN code 5610; 5630 (other than hotels)*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of art.5 para.(1) of OG no.99/2000 regarding the commercialization of products and market services, any commercial activity is carried out only by authorized merchants under the law, and according to art.6 para.(1) and (2) of the same normative act: trade in public areas takes place in fixed or mobile sales structures. The exercise of the commercialization activity in public areas is subject to the approval of local public administration authorities or the sectors of the Municipality of Bucharest, as appropriate, with respect to their own regulations and urban planning schemes.

Considering the aforementioned legal provisions, as referenced in art.63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, as amended and supplemented, the Local Council of Sector 3 adopted Decision no. 313/2017 for the approval of the Regulation regarding the conduct of activities for commercialization of products and market services within the territory of Sector 3 of the Municipality of Bucharest.

The regulation establishes the procedure for obtaining the agreement/authorization/operation permit by natural and legal persons who conduct activities for commercialization of products and market services in public areas or in any other areas intended for public use, in fixed or mobile sales structures, permanent, temporary, or, as the case may be, seasonal, within the territory of Sector 3 of the Municipality of Bucharest.
According to art.2 letter a), the operating agreement is the administrative act with individual character, through which the conditions for carrying out the activities for commercialization of products and market services are established, excluding public food units; letter b) the operating authorization is the administrative act with individual character, through which the conditions for carrying out public food activities are established (restaurant CAEN Code 5610, bar CAEN Code 5630), and according to letter c), the operation permit is the administrative act with individual character, through which the conditions for carrying out temporarily and/or seasonal commercialization activities for products and market services are established.

According to art.3 of H.C.L.S.3 no. 313/2017: economic agents who carry out or intend to carry out commercial activities, provision of services and public food activities, are obligated to submit the documentation for obtaining or extending the validity term of the operating agreement/authorization, at least 30 calendar days before the date they are to start the activity or before the expiration date of the initially authorized validity.

The fee for issuing and granting the operation permit/agreement/authorization, as well as the fee for the annual endorsement, are provided in the Decision of the General Council of the Municipality of Bucharest regarding the establishment of the levels for local taxes and fees in the Municipality of Bucharest. These will be paid at the cashier offices within Sector 3 City Hall, and proof of payment shall be submitted together with the authorization documentation.

In accordance with the provisions of art. 475 para. (3), (4), and (5) of Law no. 227/2015 regarding the Fiscal Code of Romania, as amended and supplemented, and with the Decisions of the General Council of the Municipality of Bucharest concerning the establishment of the levels of local taxes and fees in the Municipality of Bucharest, economic agents carrying out public food activities (CAEN codes 5610, 5630) must pay the public food tax in full, in advance of the authorization issuance, regardless of the remaining period until the end of the respective fiscal year, as follows:

- fee in the amount of 3,000 lei for the issuance/annual endorsement of the Operating Authorization - public food (bar, restaurant), for an area up to 500 m2;

- fee in the amount of 4,000 lei for the issuance/annual endorsement of the Operating Authorization - public food (bar, restaurant), for an area greater than 500 m2.

- the fee in the amount of 4,000 lei for issuing/annual endorsement of the Operating Authorization - public catering (bar, restaurant), for an area greater than 500 m2.

Urbanism - Request for Extension of Building Permit*

For the extension of the validity of the building permit, a standard application (according to Form - model F.12 - APPLICATION for the extension of the validity of the building permit) is filled out and submitted to the issuer, accompanied by the original issued building permit. The application for the extension of the validity of the building permit must be submitted 15 days before the expiration of its validity date.

Along with the submission of the application for the extension of the validity of the building permit, the applicant must provide proof of payment of the extension fee.

Urbanism - Request for Urbanism Certificate*

The applicant for the urban planning certificate is the natural or legal person interested in receiving information from the competent public administration authority regarding a property, land and/or constructions for the purposes defined in art. 6 of the law.

For the issuance of the urban planning certificate, the applicant shall address Sector 3 City Hall by submitting a request according to the F.1 - REQUEST form for the issuance of the urban planning certificate, in which both the identification elements of the property for which the urban planning certificate is requested shall be entered: locality, cadastral number and land registry number, where applicable, unless the law provides otherwise, as well as the elements defining the purpose of the request.

- Receipt for legal fee payment (copy):

- up to 150 sqm - 5 lei
- between 151 – 250 sqm inclusive – 6 lei
- between 251 – 500 sqm inclusive - 8 lei
- between 501 – 750 sqm inclusive – 10 lei
- between 751 – 1000 sqm inclusive – 14 lei
- over 1,000 sqm – 14+0.01 lei/sqm for areas larger than 1,000 sqm

Request for issuing the operating permit (temporary) regarding the sale of items specific to winter/spring holidays*

COMMERCIAL AUTHORIZATION PROCEDURE

According to the provisions of art. 5 para. (1) of Government Ordinance no. 99/2000 regarding the commercialization of products and market services, any commercial activity is carried out only by authorized traders under the conditions of the law, and according to art. 6 para. (1) and (2) of the same normative act: trade in public areas is carried out in sales structures with a fixed or mobile location. The exercise of commercial activities in public areas is subject to the agreement of the local public administration authorities or the sectors of the Municipality of Bucharest, as the case may be, in compliance with their own regulations and urban planning plans.

Considering the above-mentioned legal provisions, in relation to the provisions of art. 63 para.(5) letter g) of the Local Public Administration Law no. 215/2001, as subsequently amended and supplemented, the Local Council of Sector 3 adopted Decision no. 313/2017 for approving the Regulation regarding the carrying out of activities for the commercialization of products and market services in the territory of Sector 3 of the Municipality of Bucharest.

The regulation establishes the procedure for obtaining the operating agreement/authorization/permit by natural or legal persons who carry out activities for the commercialization of products and market services in public areas or in any other area intended for public use, in sales structures with a fixed or mobile location, permanent, temporary or, as the case may be, seasonal in the territory of Sector 3 of the Municipality of Bucharest.

According to art. 2 letter a), the operating agreement is the individual administrative act by which the conditions for carrying out activities for the commercialization of products and market services are established, exclusively for food service units; letter b) the operating authorization is the individual administrative act by which the conditions for carrying out food service activities (restaurant NACE code 5610, bar NACE code 5630) are established, and according to letter c), the operating permit is the individual administrative act by which the conditions for carrying out the commercialization of products and market services, carried out temporarily and/or seasonally, are established.

According to art. 3 of H.C.L.S.3 no. 313/2017: economic agents who carry out or intend to carry out commercial, service provision and food service activities have the obligation to submit documentation in order to obtain or extend the validity period of the operating agreement/authorization, at least 30 calendar days before the commencement date of the activity to be carried out or before the expiry date of the initially authorized validity.

The fee for the issuance and release of the operating permit/agreement/authorization, as well as the annual endorsement fee, is provided in the Decision of the General Council of the Municipality of Bucharest regarding the determination of local tax and fee levels in the Municipality of Bucharest. These shall be paid at the cash desks within the Sector 3 City Hall, and proof of payment shall be submitted together with the authorization documentation.

In accordance with the provisions of art. 475 para. (3), (4), and (5) of Law no. 227/2015 regarding the Fiscal Code of Romania, as amended and supplemented, and the Decisions of the General Council of the Municipality of Bucharest regarding the determination of local tax and fee levels in the Municipality of Bucharest, economic agents carrying out food service activities (NACE code 5610, 5630) must pay the full food service fee in advance of the authorization being issued, regardless of the period remaining until the end of the respective fiscal year, as follows:

- a fee amounting to 3,000 lei for the issuance/annual endorsement of the Operating Authorization - food service (bar, restaurant), for an area up to 500 m2;
- a fee amounting to 4,000 lei for the issuance/annual endorsement of the Operating Authorization - food service (bar, restaurant), for an area greater than 500 m2.

According to art.3 of H.C.L.S.3 no. 313/2017: economic agents who carry out or are to carry out commercial, service, and public food service activities, have the obligation to submit the documentation for obtaining or extending the validity period of the operating agreement/authorization, at least 30 calendar days before the start date of the activity they are to carry out or before the expiration date of the initially authorized validity period.

The fee for issuing and releasing the permit/agreement/operating authorization, as well as the annual visa fee thereof, is provided in the Decision of the General Council of the Municipality of Bucharest regarding the establishment of the levels of local taxes and fees in the Municipality of Bucharest. These shall be paid at the cash desks within the City Hall of Sector 3, and the proof of payment shall be submitted together with the authorization documentation.

In accordance with the provisions of art. 475 para. Urbanism - Request for Extension of Urbanism Certificate*

For the extension of the validity of the urbanism certificate, an application form (according to Form - model F.7 - APPLICATION for the extension of the validity of the urbanism certificate) must be completed and submitted to the issuer, accompanied by the original urbanism certificate. The application for the extension of the validity of the urbanism certificate must be submitted 15 days before the expiration of its validity date.

Upon submitting the application for the extension of the validity of the urbanism certificate, the applicant must provide proof of payment for the extension fee.

Payment can be made online at https://www.ghiseul.ro or by bank transfer to the account RO 48 TREZ 70321160203XXXXX, C.U.I-P.S.3-4420465, through TREZORERIA SECTOR 3.
The structure handling the application is the Urbanism Directorate.
