Declaration of vehicles PF/PJ*

Any person who owns a means of transport that must be registered/enrolled in Romania owes an annual tax for the means of transport, except in cases where this chapter provides otherwise.
The transport tax is owed for the entire fiscal year by the person who holds the ownership right over a means of transport registered or enrolled in Romania as of December 31 of the previous fiscal year.
In the case of acquiring a means of transport, the owner is obliged to file a declaration at the local tax office within whose territorial jurisdiction they have their domicile, headquarters, or workplace, as the case may be, within 30 days from the date of acquisition, and owes the transport tax starting from January 1 of the year following the registration or enrollment of the means of transport.

In the case where the means of transport is acquired in a state other than Romania, the owner is obliged to file a declaration at the local tax office within whose territorial jurisdiction they have their domicile, headquarters, or workplace, as the case may be, and owes the transport tax starting from January 1 of the year following its registration or enrollment in Romania.

In the case of deregistration of a means of transport, the owner is obliged to file a declaration at the tax office within whose territorial jurisdiction they have their domicile, headquarters, or workplace, as the case may be, within 30 days from the date of deregistration, and ceases to owe the tax starting from January 1 of the following year.

In the event of any situation leading to the modification of the transport tax, including a change of domicile, headquarters, or workplace, the taxpayer is obliged to file the tax declaration regarding the means of transport at the local tax office within whose territorial jurisdiction they have their domicile/headquarters/workplace, within 30 days, inclusive, from the date of the change, and owes the transport tax established under the new conditions starting from January 1 of the following year.
Filing tax declarations is an obligation also for persons who benefit from exemptions or reductions from paying the transport tax.

Leave and monthly allowance for child-rearing*

The allowance for raising children up to 2 years old, or up to 3 years in the case of a child with a disability, is a form of support to which people who, in the last 24 months prior to the birth of the child, have earned income for 12 months from salaries, independent activities, or income from agricultural activities subject to income tax according to Law no. 227/2015 regarding the Fiscal Code, with subsequent amendments and completions, or have been in one or more of the situations called assimilated periods, are entitled. Either natural parent of the child can benefit from this right, as well as the person who has adopted a child, provided they meet the eligibility criteria.

ISSUANCE OF URBANISM CERTIFICATE*

The urbanism certificate is also issued in the following situations:
  a) for the concession of land, according to the law;
  b) for the awarding by auction of the design of public works at the "Feasibility study" stage, according to the law;
  c) for lawsuits and notarial operations regarding real estate circulation, when these operations concern:
- the merging, or division of land from/into at least 3 parcels;
- divisions or mergers of parcels requested for the execution of construction and infrastructure works;
- the establishment of a right of passage regarding a property.

The above-mentioned legal operations, carried out without the urbanism certificate, are null and void.

ISSUANCE OF CIVIL STATUS CERTIFICATES*

  • Civil status certificates are issued upon request to the entitled person, based on the records and entries registered in the civil status registers.
  • Civil status certificates are issued only to citizens who possess an identity document (ID card, valid temporary identity certificate). Romanian citizens residing abroad and foreign citizens whose civil status documents are registered in the country will be issued certificates based on their passport.
  • Persons who have their domicile in localities other than those where the civil status registers are kept and cannot travel personally to obtain civil status certificates should contact the city hall in the area where they have their domicile or residence, indicating the locality where the document is found and the civil status details for identifying the document.
  • The civil status officer who receives such a request will, within 3 days, ask the city hall that keeps the civil status register to send the civil status certificate. The civil status officer who receives the completed civil status document invites the petitioner within 48 hours to collect it, under signature. The request for the issuance of the new certificate must include in detail the circumstances in which it was lost, stolen, or destroyed.
  • For minor children who do not possess identity documents, as well as for those under interdiction, the birth certificate is issued to the parent or legal representative. For minors over 14 years old who possess identity documents, the birth certificate is issued personally. The presence of the parent/legal representative is mandatory.
  • The marriage certificate can be issued to one of the spouses or, upon request, to both spouses. For the surviving spouse or in case of divorce, for justified reasons, marriage certificates can be issued with the corresponding mentions.
  • The death certificate is issued to family members or other entitled persons.
  • Requests for civil status certificates from abroad are processed by the Ministry of Foreign Affairs – Consular Relations Directorate.

Issuance of multilingual extracts of birth/marriage/death*

The Civil Status Service issues, upon request, multilingual extracts from civil status documents regarding birth, marriage, or death.
  • These are documents that have the same probative value as civil status certificates and are used by holders and entitled persons before foreign authorities in the states parties to Convention No.16 of the International Commission on Civil Status signed in Vienna on September 8, 1976, to which Romania acceded in 2012 (Law no. 65/2012).
  • The multilingual extracts of civil status documents issued under the conditions of Convention No.16 by the competent authorities of the states parties are recognized without translation, legalization or any other equivalent formality and are used under the same conditions as civil status certificates in the territory covered by the Convention.
  • The signatory states of Convention No.16 are: the Republic of Austria, the Kingdom of Belgium, Bosnia and Herzegovina, the Republic of Croatia, the Swiss Confederation, the French Republic, the Federal Republic of Germany, the Hellenic Republic, the Italian Republic, the Grand Duchy of Luxembourg, the Republic of Lithuania, the Republic of Macedonia, Montenegro, the Republic of Moldova, the Kingdom of the Netherlands, the Republic of Poland, the Portuguese Republic, the Kingdom of Spain, the Republic of Slovenia, the Republic of Serbia, the Republic of Turkey.
  • The multilingual extracts of civil status documents regarding birth and/or marriage are issued to the holders or their legal representatives, and the multilingual extracts of civil status documents regarding death are issued to family members or other entitled persons.
  • Multilingual extracts may also be issued to other persons empowered through a special power of attorney or lawyer’s authorization. Upon request, applicants can be issued several multilingual extracts completed based on the same civil status document.

Land declaration PF*

Any person who owns land located in Romania owes an annual tax for it, except in cases where this title provides otherwise.
In the case of acquiring land during the year, the owner is required to submit a new tax declaration to the local tax authority in whose territorial jurisdiction the land is located, within 30 days from the acquisition date, and owes land tax starting from January 1 of the following year.
If the classification of the land according to the rank of the locality and area changes during the year or if an event occurs during the year that leads to a change of the land tax, the tax is calculated according to the new situation starting from January 1 of the following year.
In the case of changing the category of land use, the owner is required to submit a new tax declaration to the local tax authority in whose territorial jurisdiction the land is located, within 30 days from the date of the change of use, and owes land tax according to the new situation starting from January 1 of the following year.
In the case of a situation that determines the modification of the land tax due, the person who owes the land tax is required to submit a declaration to the local tax authority in whose territorial jurisdiction the land is located, by the 25th of the month following the one in which the situation occurred.
The submission of tax declarations is also an obligation for persons who benefit from exemptions or reductions from the payment of land tax or fee.

Certificate of fiscal attestation for individuals regarding local taxes and charges*

The procedure is addressed to individuals who own immovable property. The tax certificate is issued by the Taxes and Duties Department of the TOPOLOG Town Hall at the request of taxpayers based on an application for the issuance of the tax certificate. In the case of the transfer of ownership rights over buildings, land, and means of transport, the tax certificate must certify the payment of all tax obligations owed to the local public administration authority under whose jurisdiction the property being transferred is registered for tax purposes. For the property being transferred, the owner must pay the tax due for the year in which the property is transferred.

INSERTION STIMULUS*

Eligible persons (who earned, for 12 months out of the 2 years before the child's birth, income from salaries, income from independent activities, income from agricultural activities, or found themselves in one or more of the situations called assimilated periods) who, during the period in which they are entitled to benefit from childcare leave, earn taxable income are entitled to an insertion incentive amounting to 50% of the minimum monthly allowance for child-rearing.

For persons who obtain taxable income at least 60 days before the child reaches the age of 2 years, or 3 years in the case of a child with disabilities, the granting of the insertion incentive is made until the child reaches the age of 3 years, or 4 years in the case of a child with disabilities.

This right can be granted to either of the natural parents, as well as to the person who has adopted a child, provided they meet the eligibility criteria.
