Issuance of building permit*

Construction Permit - CP - represents the document issued by the local public authority, based on which the applicant can carry out construction works. The construction permit is issued by the Urban Planning Service within the City Hall / sector where the land is located.

The issuing authority of the construction permit will establish a validity period of no more than 12 months from the date of issuance and it can be extended by another 12 months, during which the applicant is required to start the works. In this situation, the validity of the permit is extended for the entire execution period of the works provided by the permit, in accordance with the technical project.
Failure to start or finish the works within the specified deadlines leads to the loss of the validity of the permit, requiring the issuance of a new construction permit. If the characteristics do not change compared to the initial permit, a new construction permit can be issued without the need for a new urban planning certificate.

Displaying land sale offers private individuals / legal entities*

The approval necessary for the transfer of agricultural land outside the built-up area can be requested by any person who owns agricultural land outside the built-up area, for the purpose of sale.

For the implementation of the provisions of this procedure, the city halls have the following responsibilities (according to Order No. 719/740/M.57/2333 of May 12, 2014 regarding the approval of the methodological rules for the implementation of Title I of Law No. 17/2014 concerning certain regulatory measures for the sale-purchase of agricultural land situated outside the built-up area and for the amendment of Law No. 268/2001 regarding the privatization of commercial companies that manage public and private state-owned land with agricultural purpose and the establishment of the State Domains Agency):

a) register the seller's application, accompanied by the offer for the sale of agricultural land and the supporting documents provided at art. 5 para. (1) of this annex;

b) establish, organize and manage the Registry for recording offers for the sale of agricultural land situated outside the built-up area, on paper and in electronic format, which must include at least information regarding the identification data of the seller, the area of agricultural land situated outside the built-up area offered for sale, the category of use, sale price, location identified by plot and parcel or, as the case may be, the land location established by the site and delimitation plan drawn up in the 1970 Stereographic national projection system, issued by the territorial office following the receipt of the cadastral documentation for the property for which the approval was requested, the reports drafted for each stage of the procedure, the certificates issued for the free sale of the land, as well as any correspondence related to the implementation of the procedure;

c) post the sale offer at the city hall headquarters and on its own website, as the case may be, in compliance with the provisions of art. 6 para. (2) of the law;

d) based on the information contained in the sale offer, transmit the list of pre-emptors to the central structure or to the territorial structures, as the case may be. The list of pre-emptors is posted at the city hall headquarters, as the case may be, and on its own website;

e) send to the central structure, or to the territorial structures, as the case may be, the file containing all documents provided under letter a);

f) during the period provided by art. 6 para. (2) of the law, register and post at the city hall headquarters and on its own website, as the case may be, all communications of acceptance of the land sale offer, submitted by any of the pre-emptors included in the list of pre-emptors or by any other pre-emptors not included in the list and who prove this status through supporting documents after the list has been prepared, for the purpose of exercising the right of pre-emption for the sale offers in question;

g) transmit to the central structure, or to the territorial structures, as the case may be, copies of all communications of acceptance of the land sale offer, submitted by any of the pre-emptors during the period specified in art. 6 para. (2) of the law, accompanied by the documents provided by art. 6 para. (2) of this annex;

h) adopt the necessary organizational measures for conducting at the city hall headquarters the procedures regarding the exercise of the right of pre-emption and the selection of the potential buyer, with strict compliance with the provisions of art. 7 of the law;

i) draw up the record of findings regarding the conduct of each procedural stage provided for in art. 7 of the law, which records in detail the activities and actions carried out;

j) after the communication and registration of the decision regarding the seller’s selection of the pre-emptor potential buyer, transmit to the central structure or to the territorial structures, as the case may be, the name and identification data of this person, as well as copies of all records provided in letter i);

k) if no pre-emptor communicates acceptance of the seller’s offer, and the sale of the land is free under the law, issue to the seller a certificate attesting that all procedural stages regarding the exercise of the right of pre-emption have been completed and that the land is free for sale, at the price provided in the sale offer and for the area mentioned in the ownership documents or the area resulting from cadastral measurements, recorded in the land register according to Law No. 7/1996 on cadastre and real estate publicity, republished, with subsequent amendments and completions. A copy of this, accompanied by copies of all records provided in letter i), is sent to the central structure or the territorial structures, as the case may be;

l) send the seller the certificate accompanied by a certified copy of the sale offer. A copy of the certificate is sent to the central or territorial structure, as the case may be.

Granting of insertion incentive*

Eligible persons (who have earned, for 12 months out of the 2 years prior to the birth of the child, income from salaries, income from independent activities, income from agricultural activities, or have been in one or more of the situations called assimilated periods) who, during the period in which they are entitled to benefit from child-raising leave, obtain taxable income have the right to an integration incentive in the monthly amount of 50% of the minimum amount of the monthly child-raising allowance.
For persons who earn taxable income at least 60 days before the child reaches the age of 2 years, or 3 years in the case of a child with a disability, the granting of the integration incentive is made until the child reaches the age of 3 years, or 4 years in the case of a child with a disability.
Either of the child's biological parents, as well as the person who has adopted a child, can benefit from this right, provided they meet the eligibility criteria.

Granting the guaranteed minimum income (GMI) according to Law 416/2001*

​Social assistance is granted to families and single persons, Romanian or foreign citizens, as well as homeless individuals in need, who live in improvised shelters.
​Families and single persons whose incomes fall below the monthly guaranteed minimum income established by emergency ordinance. The monthly amount of the Guaranteed Minimum Income (GMI) is set by reference to the Reference Social Indicator (RSI), whose value is established by law.

Granting conditions

The application and the declaration under one's own responsibility, as well as other supporting documents regarding the family composition and the incomes earned, are registered at the city hall of the locality in whose territorial area the holder has their domicile or residence.
To process the application regarding the provision of social assistance, a social investigation will be carried out at the domicile or, if applicable, at the residence of the applicant, or at the location designated by the applicant in the case of homeless persons.
The granting or, as the case may be, non-granting of the right to social assistance is made by written decision of the mayor, and the right to social assistance is granted starting with the month following the registration of the application. In order to monitor compliance with the conditions for granting the right to social assistance, social investigations are carried out at intervals of 3 months or whenever necessary.

Declaration on sanitation tax for legal entities*

The payment of the sanitation fee is made in two equal installments:

-by March 31

-by September 30

Individuals or legal entities who pay the sanitation fee in advance by March 31, for the entire current year, will receive a 10% discount.

For failing to pay the fee by the announced deadlines, taxpayers owe late penalties of 1% for each month or part of a month, starting from the day following the due date until the payment of the owed amount in full.

Legal entities that have their registered office in Beresti-Bistrita commune, but do not carry out any activity in the commune, pay only for one person for waste collection - the company administrator.

In the case of legal entities, the calculation of the sanitation fee is made for the employees carrying out activities for at least 10 days/month, regardless of the number of hours worked. For tax declarations, modifications during the year will be made through rectifying declarations. The deadline for submitting the rectifying declaration is 30 days from the date the modification occurred.

For legal entities, the owed fee will be recalculated in situations where they can provide supporting documents (any kind of leave, travel orders, separate payrolls for work points) showing that they have employees who are not carrying out activities in Beresti-Bistrita commune.

Granting assistance for home heating during the cold season*

The heating aid for the home and the energy supplements are granted based on an application accompanied by supporting documents regarding the family composition, its income, and the heating system used. When completing the application, the applicant is obliged to correctly mention the family composition, the income of its members, as well as the movable and immovable assets owned.

The holder of the heating aid for the home and/or the energy supplement is the representative of the family or, as the case may be, the single person who meets the legal conditions for granting the aid, who requests its granting and who may be, as the case may be: the owner of the home, the lawful successor, the person who has transferred the home based on a sale-purchase contract with a maintenance clause or right of habitation, the holder of the lease, loan for use, concession contract, or another adult family member authorized by the owner of the home or by the holder of the lease contract, or, as the case may be, the legal representative of the single person who has not reached the age of 16.

Granting the allowance for family support*

The Family Support Allowance is a form of support for low-income families who are raising and caring for children up to the age of 18.
The monthly amount of the allowance is established in relation to the social reference indicator ISR
Granting conditions
The allowance is granted based on a request and a statement on one's own responsibility accompanied by supporting documents regarding the family composition, its income, and, as the case may be, regarding the school attendance of the dependent children. The documents are registered at the town hall of the locality where the family has its domicile or residence.
For resolving the request for granting the support allowance, a social investigation will be carried out at the domicile or, as the case may be, at the residence of the family.
The establishment of the right to the allowance and its amount is done by written order of the mayor, and the right to the allowance is granted starting with the month following the registration of the request.
In order to comply with the granting conditions of the allowance, social investigations are carried out at 12-month intervals or whenever necessary.
Obligations of beneficiaries
The holder of the allowance is obliged to periodically submit, after the establishment of the right to the allowance, a statement on their own responsibility regarding the family composition and the income earned by its members

Educational incentive Social vouchers for kindergarten*

Social vouchers for kindergarten are granted within a national interest program that aims to increase access to education by encouraging participation in preschool education of children from disadvantaged families, the method of identifying beneficiaries being established by decision of the Local Council.
The beneficiary of the incentive is the child, and the holder of the social voucher for kindergarten is the family representative, namely the child's legal representative.
The right to the incentive is granted starting with the month in which the beneficiary meets the eligibility criteria and is granted monthly during the period the child participates in activities organized within preschool education units, from September to June.
Social vouchers are issued only by units authorized by the Ministry of Public Finance. The operating authorization is granted according to the criteria established by MFP, by order of the minister.
The holder may use the social voucher for kindergarten during the validity period only to purchase food products, hygiene products, clothing, and/or school supplies, exclusively from economic operators selling the products provided by the law with whom the issuing unit has concluded contracts for specific social voucher services.
The holder is prohibited from:
a) requesting and/or receiving any cash change for the social voucher for kindergarten, if the amount corresponding to the requested products is less than the nominal value of the voucher;
b) selling the social vouchers for kindergarten in exchange for money and/or other goods and/or services;
c) using the social vouchers for kindergarten in shops, locations, units, or markets of any kind that do not sell food products, hygiene products, clothing, and/or school supplies and do not display at the entrance the special stickers of the issuing unit;
d) using the social vouchers for kindergarten to purchase products other than food, hygiene products, clothing, and/or school supplies.

The state allowance for children is granted to all children up to the age of 18, without discrimination. The state allowance for children is also granted to young people who have reached the age of 18 and are attending high school or vocational education, organized according to the law, until they finish, except for those who repeat the school year, except for those who repeat due to health reasons, proven by a medical certificate.

Children of foreign citizens and stateless persons residing in Romania, under the law, also benefit from the state allowance for children if they live together with their parents.

ANNEX no. 24 - Notification for opening the succession procedure*

The notification for opening the succession procedure is the administrative document required in the procedure for succession debate, which takes place exclusively before the competent public notary or the court in whose territorial jurisdiction the deceased had their last domicile. Annex 24 does not attest the status of heir nor the ownership right over movable or immovable assets held by the deceased.

The calculation of the sanitation tax for individuals is based on the declaration regarding the establishment of the sanitation tax for individuals, which must be submitted within 30 days from the date of acquiring the property or from the occurrence of any changes regarding the number of people living in the property.

Necessary documents for the sale-purchase of agricultural land located outside the built-up area*

The sale of agricultural land located outside city limits, without respecting the right of pre-emption or without obtaining the necessary permits, is prohibited and is sanctioned with absolute nullity.

The sale of land by individuals/legal entities can be made with respect for the right of pre-emption, in the order of the pre-emptors' rank.

The publicity of the offer to sell agricultural land located outside city limits - the person who wishes to sell must register, at the Town Hall in whose administrative area the land is located, a request for the posting of the sale offer for the respective area, to notify the pre-emptors. Within 5 working days from the date the request is registered, the Town Hall will post the sale offer for 45 working days at its headquarters. Also, within 10 days, the Town Hall is obliged to notify the holders of the right of pre-emption regarding the registration of the sale offer. If the right of pre-emption is not exercised, potential buyers may submit to the Town Hall a file containing supporting documents regarding fulfillment of the conditions, within 30 days from the expiration of the above-mentioned 45 working days. If the right of pre-emption is not exercised and if none of the above potential buyers fulfill the conditions within the legal term to purchase the agricultural land located outside city limits, its sale can be made to any individual or legal entity, in accordance with the law.
