Procedure regarding the cancellation of the tourism license and/or the annex of the tourism license for the branch/subsidiary/representative/secondary office of a travel agency*
In the case of the permanent cessation of activity in the travel agency and/or in its branch/subsidiary/representative office/secondary office, the economic operator shall request the cancellation of the tourism license and/or the annex of the tourism license at least 30 days before the definitive cessation of activity. For this purpose, the following documentation shall be submitted to the headquarters of the central public institution responsible for tourism (see Required Documents): (1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In case of incomplete documentation, the central public institution responsible for tourism shall inform the applicant, within 5 working days from the date of registration of the application, by means of a notification, regarding the need to submit additional documents, as well as regarding the consequences on the documentation analysis period provided for in para. (1); (3) If, within 45 days from the date of issue of the first notification, the documentation provided for in para. (2) is not completed, it will be closed.
*Procedure regarding the homologation of ski slopes and routes for recreational use*
The economic operator submits to the headquarters of the central public authority responsible in the field of tourism an application accompanied by the documentation provided for in Annex no. 1 to OMT no. 491/2001. The homologation of ski slopes for leisure is carried out by the central public authority responsible in the field of tourism, based on findings made on site by a commission composed of representatives of this authority as well as representatives of the county councils. The commission carries out its activity with the consultation of representatives of professional associations in the field and the local council in whose territorial jurisdiction the slope or ski trail subject to homologation is located. The request for homologation must be made at least 45 days before opening the slopes for operation. The documentation is verified within 5 days from the date of registration, and if necessary, a request to complete it will be issued if it is incomplete. Within 30 days from the date of registration of the complete documentation, the homologation certificate is issued, if the minimum homologation criteria are fulfilled.
*Procedure regarding the issuance of the tourism license annex for the tour operator/intermediary travel agency*
For the issuance of the annex to the tourism license for its secondary office, the economic operator holding a tourism license for a tour operator/intermediary agency submits to the headquarters of the central public institution responsible for tourism a documentation with the following content (see below, Required Documents). (1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but not more than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible for tourism informs the applicant, within 5 working days from the date the application is registered, through a notification, regarding the need to submit additional documents, as well as the consequences regarding the documentation analysis term provided in paragraph (1); (3) If within 45 days from the date of issuance of the first notification the documentation provided in paragraph (2) is not completed, it is filed.
*Procedure regarding the issuance of the tourism license and, as the case may be, the annex to the tourism license for the branch/office/secondary headquarters/its representative office, in the event of changing the type of travel agency*
For the issuance of the tourism license and, as the case may be, the annex to the tourism license for the branch/subsidiary/secondary office/its representative office, in the event of a change in the type of tourism agency from organizer to intermediary and vice versa, the economic operator shall submit the following documentation to the headquarters of the central public institution responsible for tourism (see Required Documents below). (1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible for tourism shall inform the applicant, within 5 working days from the date of registration of the request, by means of a notification, about the need to submit additional documents, as well as about the consequences regarding the deadline for analyzing the documentation provided in paragraph (1); (3) If, within 45 days from the date of issuance of the first notification, the documentation provided in paragraph (2) is not completed, it will be closed.
*Procedure regarding the issuance of the tourism license and, as the case may be, the annex(es) to the tourism license in the event of a change in the name of the organizing/intermediary travel agency*
For the issuance of the tourism license and, as the case may be, the annex to the tourism license for its secondary office, in case of a change in the name of the organizing/intermediary travel agency, the economic operator shall submit the following documentation at the headquarters of the central public institution responsible in the field of tourism (see below, the Required Documents section). (1) The documentation submitted by the applicant is reviewed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible in the field of tourism shall inform the applicant, within 5 working days from the date of registration of the application, by a notification, regarding the need to submit additional documents, as well as the consequences on the review period provided for in para. (1); (3) If within 45 days from the date of issuance of the first notification the documentation provided for in para. (2) is not completed, it will be closed.
*The procedure for notifying the central public institution for tourism regarding the temporary and occasional provision of the profession of tourist guide on the territory of Romania*

Procedure for issuing the classification certificate for natural persons*
The procedure for issuing certificates and travel guides badges for individuals who fulfill the conditions and criteria provided by the legislation in force to exercise the tourism guide profession
The issuance of the certificate and badge of tourist guide is done by the central public authority responsible for tourism, at the applicant's request, based on the application accompanied by the documentation provided by OMTCT no. 637/2004. Within a maximum of 30 days from the date of registration of the complete documentation, the certificate and badge of tourist guide are issued in the name of the applicant.
*Procedure regarding the tourist authorization of nautical leisure activity*
The economic operator submits to the headquarters of the central public authority responsible in the field of tourism the application accompanied by the documentation provided by OMTCT no. 292 from 2003.
The documentation is checked within 5 days from the date of registration, and, if applicable, an address for completion will be drawn up if it is incomplete.
Within 30 days from the date of registration of the application by the economic agent, the nautical leisure area is checked and the tourist authorization certificate is granted only if the conditions regarding the arrangement, equipment, and outfitting of the nautical leisure area are met.
*Procedure regarding the issuance of classification certificates for tourist accommodation structures with lodging and/or public catering functions*
The economic operator submits to the headquarters of the central public authority responsible in the field of tourism a standardized application for obtaining the classification certificate (see Required Documents) accompanied by the documentation provided in the annex to the Order of the ANT President no. 65/2013 for the approval of methodological norms.
Within a maximum of 30 days from the date of registration of the complete documentation, a Provisional Operating Authorization is issued for the requested type of unit and classification category, granting the economic operator the right to operate until the on-site verification of the respective tourist accommodation structure. In the case of incomplete documentation, the central public authority responsible for tourism informs the applicant, within 5 working days from the date of registration of the application, through a notification, regarding the necessity to submit additional documents, as well as the consequences on the analysis deadline of the documentation provided above. If within 6 months (180 days) from the date of issuance of the notification, the documentation is not completed, it is archived. The on-site verification of the tourist accommodation structure is carried out within 90 days from the date of issuing the Provisional Operating Authorization and the Classification Note is drawn up.
If, on the date of on-site verification, minor deficiencies are found that can be remedied urgently, the commission may grant a short remediation period of a maximum of 7 working days, making mention in the classification note regarding these aspects. The economic operator is obliged, after remedying the deficiencies, without exceeding the given deadline, to prove the remediation of the deficiencies by submitting supporting documents.
The issuance of the classification certificate for the tourist accommodation structure and of the nominal accommodation assignment form by categories and types and/or the nominal assignment form of premises in the tourist accommodation structures with public catering functions is carried out within 15 days from the date of drawing up the Classification Note.
*Procedure regarding the issuance of the travel license in case of a change of headquarters of the tour operator/intermediary travel agency*
For the issuance of the tourism license, in the event of a change of headquarters, the economic operator submits to the central public institution responsible for tourism a documentation with the following content (see below, Required Documents). (1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible for tourism informs the applicant, within 5 working days from the date of registration of the request, by notification, regarding the need to submit additional documents, as well as the consequences on the documentation analysis deadline provided in para. (1); (3) If within 45 days from the date of issuing the first notification the documentation provided in para. (2) is not completed, it is filed.
*Procedure for authorizing professional training programs in the tourism, hotels, restaurants sector*
The procedure applies to professional training programs related to professions/occupations in the tourism, hotels, and restaurants sector, for which there are special requirements for organizing professional training, in order to authorize these programs, of the professional training providers by the authorization commissions coordinated by the National Authority for Qualifications under the conditions of the law.
*Procedure regarding the issuance of a duplicate tourism license/annex to the tourism license*
For the issuance of a duplicate tourism license/annex to the tourism license, in case of loss or deterioration, the economic operator holding it submits to the headquarters of the central public institution responsible for tourism a file containing the following: (see below, Required Documents). (1) The documentation submitted by the applicant is reviewed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible for tourism informs the applicant, within 5 working days from the date of registering the application, through a notification, regarding the need to send additional documents, as well as the consequences regarding the review period of the documentation provided in para. (1); (3) If, within 45 days from the date of issuing the first notification, the documentation provided for in para. (2) is not completed, it is filed.
*Procedure regarding the issuance of the tourism license for the tour operator/intermediary travel agency*
The economic operator requests the central public institution responsible in the field of tourism to issue the tourism license based on documentation with the following content (see Required Documents). (1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible in the field of tourism informs the applicant, within 5 working days from the date of registration of the application, by notification, regarding the need to submit additional documents, as well as the consequences on the documentation review period provided in paragraph (1); (3) If within 45 days from the issuance of the first notification the documentation provided in paragraph (2) is not completed, it will be shelved.

Procedure regarding the issuance of the prior operating permit for tourist accommodation structures with leisure functions in tourist resorts*
Economic operators who carry out leisure activities in tourist resorts are required to request a prior approval, before obtaining the operating permit issued by the city halls.
Procedure regarding the accreditation of national centers for tourist information and promotion*
The local or county council, as the case may be, under whose authority the national center for tourist information and promotion operates, requests the issuance of the accreditation certificate from the central public institution responsible for tourism, with documentation containing the requirements specified in the Required Documents section.
The accreditation documentation is checked for compliance with accreditation criteria and the accreditation certificate is issued according to the model presented in the Final Documents section. The issuance of the accreditation certificate is made within a maximum of 30 days from the date of registration of the complete documentation. If the national center for tourist information and promotion does not meet all the criteria to be accredited, the interested local or county council, as the case may be, will be informed in writing within the same period. In the case of incomplete documentation, the central public institution responsible for tourism informs the applicant about the need to submit the missing documents. If, within 180 days from the date of the notification to the applicant, the documentation is not completed, it will be filed.
*Procedure for the approval of urban planning documentation PUG for tourist resorts*

Procedure regarding the authorization of beaches for tourism purposes*
The applicant economic operator, referred to as the beach user, who has concluded a lease contract with the Romanian Waters National Administration, submits to the headquarters of the central public authority responsible for tourism, the application accompanied by the documentation provided by OMDRT no. 1204 of 2010. The documentation is verified within 5 days from the date of registration, and if necessary, a request for completion will be issued if the documentation is incomplete. Within 15 days from the date of registration of the beach user's application, on-site verification of the fulfillment of mandatory and optional criteria is carried out by the staff of the Ministry of Tourism, and the result of the verification is recorded in the tourist authorization note for the beach. Within 30 days from the date of registration of the complete documentation, the tourist authorization for the beach is issued.
*Procedure regarding the issuance of the tourism license in the case of changing the holder of the tourism license*
In the case of changing the economic operator, holder of the tourism license, who carries out activities of organizing, offering, selling services and/or travel service packages, the documentation will include: (see below, Required documents). (1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration. (2) In the case of incomplete documentation, the central public institution responsible for tourism shall inform the applicant, within 5 working days from the date of registration of the application, by notification, regarding the need to submit additional documents, as well as on the consequences for the review deadline stipulated in para. (1); (3) If within 45 days from the date of issuing the first notification the documentation provided in para. (2) is not completed, it will be closed.
*AUTHORIZATION OF ECONOMIC OPERATORS ESTABLISHED IN EU / EEA MEMBER STATES , AUTHORIZED TO PROVIDE SPECIFIC SERVICES OF TRAVEL AGENCIES IN THEIR STATE OF ESTABLISHMENT WHICH INTENDS TO PROVIDE CROSS- BORDERS SERVICES

In the situation where changes have occurred in the structure of spaces with accommodation and/or public catering functions, the economic operator owner and/or administrator of tourist reception structures submits the documentation for issuing a new annex sheet within 30 days from the occurrence of the changes.
Procedure for submitting the Statement regarding the activity carried out by organizer travel agencies*
The declaration is to be filled in by the economic operator holding a valid tourism license for the organization activity, issued under the conditions of the specific legislation in force by the central public authority responsible in the field of tourism, by completing a form in accordance with the obligations provided by art. 19 of Government Ordinance no. 2/2018 regarding travel service packages and linked travel services, as well as for the amendment of some normative acts. The declaration is submitted monthly, no later than the 15th (inclusive) of the following month, by the economic operator owner/administrator of the organizing travel agency, according to the legal provisions in force. The declaration is sent as an EXCEL file with the .P7M/.P7S extension, by electronic means – using the PCUe platform, in accordance with the completion instructions and the requirements imposed by the provisions of O.M.T. no. 1.183 of October 10, 2018 on approving the model, content, submission method, and management of the "Declaration regarding the activity carried out by organizing travel agencies", as subsequently amended. To submit the declaration, the economic operator must hold a qualified certificate, issued under the conditions of Law no. 455/2001 regarding electronic signature, republished.

The European Professional Card (EPC) for the profession of mountain guide in Romania*
The European Professional Card is an electronic certificate that attests either that the professional has met all the necessary conditions to temporarily and occasionally provide services in a host Member State, or recognition of professional qualifications for establishment in a host Member State.
The holder of mountain guide qualifications may choose to request such a card either to apply the procedure for temporarily and occasionally performing the profession of tourism guide in Romania or the procedure for recognition of professional qualifications based on Law no. 200/2004 regarding the recognition of professional qualifications, with subsequent amendments and completions, as applicable.
To facilitate the free movement of mountain guides within the EU, the European Commission, based on Regulation 983/2015 regarding the procedure for issuing the European Professional Card and the application of the alert mechanism under Directive 2005/36/EC of the European Parliament and Council, has provided for the introduction of the European Professional Card (EPC) for mountain guides. The EPC is valid indefinitely if you settle long-term, or 12 months if you provide services temporarily.
To obtain the EPC, interested persons will access the Your Europe portal (“Europa Ta”), where all documents requested by the competent authority from each Member State are published, and will create an account on the ECAS platform. Before submitting your request, check that you have complied with the requirements published in the Simulator on the EPC page, on the Your Europe website. - Each requested document (copies of originals, copies of certified translations, etc.) must be uploaded as a single PDF file containing all pages of the document;
- For each uploaded document, the applicant must complete the identification data and address of each issuing authority;
- All submitted documents will be validated as authentic and valid through the Internal Market Information System (IMI) by the competent authority from the Member State of origin (according to EPC Regulation 2015/983).
The central public authority in tourism (Tourism Department within the Ministry of Economy, Energy and Business Environment) is the competent authority for issuing EPCs for mountain guides for the purpose of establishment in Romania to practice this profession.
List of regulated professions in Romania: The profession of mountain guide is included in the category of specialized tourism guides for certain segments of tourism services; the profession of tourism guide is regulated in Romania and is included in the List of regulated professions - Annex no. 2 to Law no. 200/2004 regarding the recognition of professional qualifications, with subsequent amendments and completions.
FEES: No fees are charged for issuing the EPC.
The registers/databases regarding mountain guides for whom the European Professional Card was issued – at the moment the database contains no records.
The procedure for approval of technical documentation regarding constructions in the field of tourism*
The local public authority or interested individual or legal entity requests the issuance of the approval from the central public institution responsible for tourism based on documentation with the following content (see Required documents); .
a) tourist accommodation structures:
- hotel, apartment-hotel, motel, villa, bungalow, chalet, holiday village, camping, guesthouse with a capacity greater than 3 rooms, regardless of their comfort category;
b) dining service structures:
- classic restaurant, specialized restaurant, restaurant with national or local specifics, brasserie, beer hall, summer garden, bars of any type, fast food units—self-service restaurant, "express" buffet, pizzeria, snack-bar-pastry shop, bakery, organized in:
* units arranged in special designated spaces, included within tourist accommodation structures;
* independent structures located within tourist resorts;
c) tourist leisure structures:
- clubs, casinos, multipurpose halls, facilities and equipment specific to tourist leisure—cable tourist transport, ski slopes, and similar;
d) spa treatment structures:
- spa tourism complexes (according to Government Ordinance no. 58/1998: buildings that include within the same property or in physically or functionally connected buildings accommodation, dining, and spa treatment structures, possibly leisure structures);
2. documentation regarding the specific functionality of existing constructions in the tourism field, subject to modernization, rearrangement, extensions, or other works that modify their tourism function;
3. documentation on constructions that will be structurally and functionally modified in order to obtain a tourism-related functionality.
(1) The documentation submitted by the applicant is analyzed and resolved as soon as possible, but no later than 30 calendar days from the date of its registration;
(2) In the case of incomplete documentation, the central public institution responsible for tourism informs the applicant, within 5 working days from the date of registration of the request, through a notification, about the need to submit additional documents, as well as about the consequences regarding the analysis deadline provided in paragraph (1);
(3) If within 60 days from the date of the notification, the documentation provided in paragraph (2) is not completed, it is closed.

Establishment and operation of an enterprise
The business incubator is the structure created to support the development of businesses that are at the beginning of their activity.
Selected companies are hosted in the Business Incubator for a determined period of time, during which they can benefit from financial support, consulting services, and office spaces.
Within the PMAT platform, you can obtain titles for the following types of business incubators:
- With a mixed portfolio.
- Technological.
- Business academic.
- Agro-business incubator.
- Social.
- Specific to a sector, leveraging the existing endogenous potential in a region.
- Virtual.
- For non-agricultural activities in the rural environment.
Obtaining an incubator title involves the following steps:
- Enroll in the PMAT platform as a Business Incubator.
- Authentication (the platform allows authentication with ROeID and eIDAS).
- Submit an application.
- Send clarifications (only if necessary).
- Download artifact (business incubator title).
Cross-border activities
In order to have access to the New Authorization Issuance (operational process associated with opening a new foreign representative office) services, the following steps are required:
- Enrollment in the PMAT platform as a foreign representative office.
- Authentication (the platform allows authentication with ROeID and eIDAS).
- Submission of documentation.
- Sending clarification response (only if applicable).
- Downloading artifact (authorization).
