The application is submitted by applicants such as commercial companies, agricultural companies and other forms of association in agriculture, associations and foundations, agricultural cooperatives, any other legal form of association, in accordance with the legislation in force, to MADR/MMAP, through DAJ/Forest Guard, for compliance verification based on the criteria for producer groups in Annex 2, accompanied by the following documents: a. the application requesting recognition as a producer group/in accordance with the form provided in Annex no. 3 b. a copy of the resolution/decision of the management body/general meeting c. a copy of the articles of incorporation and/or the statutes showing fulfillment of the criteria from Government Ordinance no. 37/2005 d. proof of producer status of agricultural producers, as follows - members who are natural persons present the producer certificate, issued in accordance with the provisions of Law no. 145/2014 - members who are authorized natural persons, individual enterprises, and family enterprises established under GEO no. 44/2008 and members who are legal entities present a copy of the registration certificate at the trade register office/fiscal registration certificate, as applicable e. in the case of agricultural producers, the legal entity presents documents showing it has qualified personnel corresponding to the group(s) of products for which it is recognized, or stipulates in the articles of incorporation that in the first year after recognition it will have such personnel or will contract specialized services f. in the case of forestry producers, the entity presents any document showing activity in the forestry field and demonstrates professional training in the field, and members of this entity own forest land g. the list of main members, drawn up according to the form provided in Annex no. 4, approved by the general meeting/management body, depending on the provisions of the articles of incorporation regarding the production material base, specified in Annex no. 4, should also include the surface area and type of crops, in the case of crop farms, respectively the herd size, in the case of livestock farms, showing that the producer group/producer organization to be recognized can achieve a minimum value of marketed production VPC, according to the provisions of Government Ordinance no. 37/2005 h. copies of documents proving the qualification of personnel, if applicable i. copies of contracts for the provision of specialized technical assistance services or own registry of specific technical assistance activities provided by own personnel, if applicable j. copies of the articles of incorporation of the legal entity members k. declaration on own responsibility of members regarding their belonging to another producer group or organization, in accordance with the provisions of Government Ordinance no. 37/2005 l. certificate issued in accordance with the provisions of Government Ordinance no. 37/2005, if applicable by exception from the provisions of EU Regulation no. 1.308/2013, in situations where a member of a producer group/producer organization owns separate production units located in different geographical areas, they may belong to several recognized producer groups/producer organizations for the same group(s) of products or for the same product(s), depending on the location of the production units, provided they follow the justification procedure established in the methodological rules for the implementation of legislative provisions. The application is submitted by applicants for one or more product groups or for one or more products from the product groups mentioned in art.6, para.2 letter a and letter b - Order 358/2016 commercial companies, agricultural companies and other forms of association in agriculture, associations and foundations, agricultural cooperatives, any other legal form of association, according to the legislation in force, to MADR/MMAP, through DAJ/Forest Guard, for verification of compliance based on the criteria for producer organizations Annex 5, accompanied by the following documents: a. the application requesting recognition as a producer organization according to the form provided in Annex no. 3 b. a copy of the decision/resolution of the governing body/general assembly mentioning its agreement for undertaking the legal steps in order to obtain recognition c. a copy of the articles of incorporation and/or the statute, showing compliance with the criteria from Government Ordinance no. 37/2005 d. proof of producer status for agricultural producers, as follows - individual members present the producer certificate, issued in accordance with the provisions of Law no. 145/2014 - authorized natural person members, individual enterprises and family enterprises constituted according to GEO no. 44/2008, as well as legal person members, present a copy of the registration certificate from the trade registry / tax registration certificate, as appropriate e. in the case of agricultural producers, the legal person presents documents showing that it has qualified personnel corresponding to the group(s) of products and/or products for which it is recognized, or includes in the articles of incorporation that within the first year from recognition such personnel will be employed or specialized services will be contracted f. in the case of forestry producers, the entity presents any document showing activity in the forestry field and proves professional training in the field, and the members of this entity own forest land g. the list of full members, drawn up according to the form whose model is provided in Annex no. 4, approved by the general assembly/governing body, depending on the provisions of the articles of incorporation; information regarding the production material base, specified in Annex no. 4, must also include the size of the areas and type of crops in the case of crop farms, or the size of the livestock in the case of livestock farms, indicating that the producer group/producer organization to be recognized can achieve a minimum VPC value, according to the provisions of art. 6 para. 2 of Government Ordinance no. 37/2005 h. copies of documents proving the qualification of the personnel, as applicable i. copies of contracts for the provision of specialized technical assistance services or the organization’s own register with specific technical assistance activities provided through own personnel, as applicable j. copies of the articles of incorporation of the legal person members k. a sworn statement by members regarding their membership in another group or producer organization, in accordance with the provisions of art. 6 para. 4 and 5 of Government Ordinance no. 37/2005 l. certificate issued in accordance with the provisions of art. 6 para. 5 of Government Ordinance no. 37/2005, as applicable By way of exception to the provisions of EU Regulation no. 1.308/2013, in the case where a member of a producer group/producer organization holds its own separate production units located in different geographical areas, it may be part of several recognized producer groups/organizations for the same group(s) of products or the same product(s), depending on the location of the production units, provided that the justification procedure for this situation established in the methodological norms for the application of the legislative provisions is followed.*
