Necessary documents for issuing the certificate with data from the national register of persons’ records.
Law no.677/2001—for the protection of individuals regarding the processing of personal data and the free movement of such data establishes the general rules for processing personal data, the rights of the data subjects and the obligations of the operators. This law protects the private and family life of citizens.
Personal data means any information referring to an identified or identifiable natural person (name and surname, domicile or residence address, date of birth, data from civil status documents, ID card series and number, personal numerical code)
Natural or legal persons may request, based on motivated written applications, the communication of certain personal data from the National Register of Persons’ Records, regarding civil status data, identity documents, domiciles and residences, and the assigned personal numerical code.
If a natural person requests the transmission of certain personal data through an individual law firm, it is necessary to submit a written application in this respect, which will be filed for competent resolution at the public community service for persons’ records in the area where the natural person whose data is requested resides.
According to the normative acts, the provision of certain personal data may take place only after obtaining, in advance, the written consent of the data subjects (by which they expressly and unequivocally declare whether or not they agree with the provision of the requested data).
The consent of the data subjects is not necessary when there is a justified legal basis.
It is considered a justified legal basis, requests for certain personal data received from police authorities, the Ministry of Defense, the Romanian Intelligence Service, the Prosecutor’s Office, Justice, specialized social protection institutions regarding minors or other entitled persons, natural persons whose legitimate interests are proven by documents evidencing the justified legal basis, natural persons requesting communication of their own personal record data, etc.
