1. Receiving and registering in the general record program the applications regarding the reservation of the names of associations, foundations, or federations, sent by mail or submitted at the MJ headquarters.
2. Checking availability, preparing proofs and negative/explanatory responses.
3. Sending proofs and responses by mail, or handing them directly to the applicants or their representatives, at the MJ headquarters.
4. Receiving persons requesting information regarding the name reservation procedure and the submitted applications, within the established public service schedules.
Prior approval from SGG for the use of the words “national”, “Romanian” and their derivatives in the name.
The deadline for resolving name reservation requests is 3 days from the date of receipt of the request, calculated according to the Civil Procedure Code. The application must be accompanied by proof of payment of the fee and, if applicable, the prior approval from SGG.
Name reservation fee of 36 lei, respectively fee for extending the name reservation of 18 RON. According to the Order of the Minister of Justice no. 3258/C/2020, the fees are paid into the availability account of the Ministry of Justice no. RO62TREZ7005032XXX013994, opened at the Treasury and Public Accounting Department of the Municipality of Bucharest, by any means of payment (payment order, postal mandate, bank transfer, etc). In the case of payment by bank transfer, the tax code of the beneficiary (Ministry of Justice) is 4265841. Proof of payment is attached to the name reservation request. Validity period - 6 months for name availability, respectively 3 months for extending the name reservation.

Contest procedure: Art. 8 para. 2^1 of G.O. no. 26/2000: “Within the procedure for verifying the legality of the registration request and the documents provided in art. 7 para. 2, the judge appointed by the president of the court checks the compliance with the provisions of art. 7 para. 3 and may order, by a reasoned decision, the registration of the association in the Register of Associations and Foundations, even if there is a reasoned refusal by the Ministry of Justice to issue the certificate of name availability, if considered unfounded.” Art. 45 para. 4 of OMJ no. 954/2000: “The reasoned refusal of the Ministry of Justice may be removed by the court under the conditions of art. 8 para. 21 of the ordinance.”
