The filing of a design/model registration application with OSIM is not mandatory and is subject to payment, the fees regime being established by Government Ordinance no. 41/1998, regarding fees in the field of industrial property protection and the rules for their use, as amended and supplemented. The form called “Design/Model Registration Application” must be completed in 3 copies, accompanied by graphic reproductions and proof of payment of the applicable fees. This can be submitted online, by post or at the OSIM headquarters. The examination of a design/model registration application is carried out in accordance with the provisions of Law 129/1992 regarding the protection of designs and models, republished in 2007, as well as the Implementing Regulation. The public registers can be consulted here, and OSIM decisions are subject to appeal.
