STANDARD REQUEST for the issuance of the operating agreement in which the identification elements of the merchant will be recorded: merchant name, registered office, tax identification code (CUI), registration number at the Trade Registry Office, representative, address of the work point for which the operating agreement is requested, the activities to be carried out at this work point, the proposed operating schedule. This standard request accompanies documentation that includes documents established in correlation with the activity to be carried out at the work point, in compliance with applicable legislative provisions.*

The certificate of findings regarding the activities carried out at the work point that is the subject of the request, issued by the Trade Register Office, contains strict information related to the work point and lists the activities actually carried out at the work point. In the event that this certificate of findings includes activities that are not actually carried out at the work point and for which an operating permit is not requested, the merchant's administrator shall provide a statement made on their own responsibility regarding the activities carried out at the work point.*

The updated land registry, not older than 90 days, of the property in which the commercial activity or service provision is carried out with the registration of the corresponding function. The function registered in the land registry must be closely correlated with the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions, in accordance with the local urban planning regulations in force. In the situation where, in the land registry, the space in question is designated as a residence or has another purpose, but different in function from that for which the operating agreement is requested, the urbanism certificate and the approvals/agreements mentioned therein / the building permit, as the case may be, issued by the Urbanism Directorate for the change of purpose/function based on the provisions of the approved urban planning regulations, respecting the classification of permitted uses by categories of functions, will be presented. In the situation where the commercial/service provision activity is to be carried out in a temporary and removable construction, for which there is a building permit, such as kiosk, booth, or stand or other similar types (for commercial activity), located on private property (with the exception of those placed on public or private property of the municipality), the updated land registry of the plot of land on which it is located, not older than 90 days, will be presented, if it is not possible to present a land registry with the registration of this construction. An excerpt from the land registry will NOT be presented in the case of spaces with another destination that are the subject of lease contracts with the local public administration authority.*

Merchants who do not own the premises of the work point that is to be authorized must submit, along with the documents mentioned in the previous point, any document/contract that regulates the lease in their favor. If this lease regulation document is not for an indefinite period, it is considered that the authorization request is made for a limited period, within the validity of the lease.*

The written agreement of the co-owners - co-dividers (where applicable) will be given with the specification of the identification data of the signatories, namely the identity document and the personal identification number*

The site plan showing the location of the property where the commercial activity or service provision takes place: site plans taken from the internet are also valid.*

A photograph of the sale structure's facade will be presented, showing the access to it.*

The plan marked for no alterations annexed to the building permit for the sales structure space or the survey of the respective space shall be presented.*

It is a standard form that includes information regarding the sales structure.*

It will be presented by the food service units within the accommodation structures and those managed by tourism commercial companies, regardless of location.*

The permit regarding fire safety or denial issued by the competent authority Inspectorate for Emergency Situations "Avram Iancu" of Cluj County.*

Statement on own responsibility regarding the exact number of seats at tables, respectively the total number of people that can be accommodated within the structure in question. It will be formulated on the own responsibility of the merchant's representative.*

Declaration regarding the categorization of the public catering unit in the context of catering activities: the declaration provided in Annex no. 2 to Government Decision no. 843/1999 must be completed.*

Environmental permit issued by the Cluj Environmental Agency for the activities included in annex 4 to HCL 851/2017 (see regulations)*

Certification of compliance with hygiene and public health standards, issued by the Cluj Public Health Directorate, for activities included in annex 5 to HCL 851/2017 (see normative acts)*

The document issued by the Sanitary-Veterinary Directorate of Cluj County for the activities included in annex 6 to HCL 851/2017 (see normative acts)*

The certificate of completion of hygiene courses or the high school diploma with an economic profile will be presented for the employed staff.*

The sanitation contract concluded with the sanitation company serving the respective area will be presented.*

One of these documents will be presented for the sales structure that is being authorized.*

Merchants who carry out public catering activities (CAEN code 561 and 563) or recreational and entertainment activities (CAEN code 932) at the sales structure and request operating hours after 10:00 PM must also present the Cluj-Napoca Municipal Police endorsement for operating according to the requested schedule, based on the relevant legislation.*

A copy of the building permit/subscription for occupying the public domain with access roads, valid at the time, will be presented in the situation where access to the sales structure subject to authorization is made via distinct arrangements built on public domain, other than those corresponding to public alleys. In the event that the sales structure does not have an access way, a statement on own responsibility made by the merchant will be submitted.*
