STANDARD REQUEST for the issuance of the operating agreement in which both the identification elements of the merchant will be entered: merchant name, registered office, CUI, registration number at the Trade Registry Office, representative, address of the work point for which the operating agreement is requested, activities to be carried out at this work point, proposed operating schedule. This standard request is accompanied by documentation comprising documents established in correlation with the activity to be carried out at the work point, in compliance with the relevant legislative provisions.*

The ascertainment certificate regarding the activities carried out at the work point which is the subject of the request, issued by the Trade Registry Office, contains strict information regarding the work point and lists the activities that are actually carried out at the work point. In the situation where this ascertainment certificate includes activities that are not actually carried out at the work point and for which an operating permit is not requested, the administrator of the trader shall present a statement formulated on their own responsibility regarding the activities carried out at the work point.*

The updated land register, not older than 90 days, of the property in which the commercial activity or provision of services is carried out, with the corresponding function registered. The function registered in the land register shall closely correlate with the provisions of the approved urban planning regulations, respecting the classification of permitted uses by function categories, according to the current Local Urbanism Regulation. If the land register shows that the space in question is designated as a residence or has another destination, different in function from the one for which the operating approval is requested, the urbanism certificate and the approvals/agreements mentioned therein / construction authorization, as applicable, issued by the Urbanism Directorate for changing the destination/function based on the provisions of the approved urban planning regulations, must be presented, respecting the classification of permitted uses by function categories. If the commercial activity/service provision is to be carried out in a provisional and removable construction, for which there is a building permit, such as a kiosk, booth, or stall or similar (for commercial activity), located on private property (except for those located on the public or private domain of the municipality), the updated land register of the land property on which it is located, not older than 90 days, must be presented if it is not possible to present a land register with the registration of this construction. The CF extract will NOT be presented in the case of spaces with another destination that are the subject of lease contracts with the local public administration authority.*

Merchants who do not own the space associated with the work point that is to be authorized must submit, in addition to the documents mentioned in the previous point, any document/contract governing the lease/rental in their favor. If this lease governing document is not for an indefinite period, the authorization request is considered to be made for a limited period, within the validity of the lease.*

The written consent of co-owners - co-dividers (where applicable) will be given with the specification of the identification data of the signatories, respectively the identity document and the personal numeric code*

The site plan showing the location of the building where the commercial or service activity is carried out within the area: site plans obtained from the internet are also valid.*

A photograph of the sales structure façade will be presented, showing access to it.*

The plan intended to remain unchanged will be presented as an annex to the building permit for the sales structure space or the survey of the respective space.*

It is a standard form that includes information regarding the sales structure.*

The fire safety authorization or denial issued by the competent authority, the "Avram Iancu" Emergency Situations Inspectorate of Cluj County.*

Environmental permit issued by the Cluj Environmental Agency for activities included in Annex 4 to HCL 851/2017 (see regulatory documents)*

The sanitation contract concluded with the sanitation company serving the respective area will be presented.*

One of these documents will be presented for the sales structure that is being authorized.*

A copy of the building permit/subscription for occupying the public domain with access roads, valid, will be submitted in the situation where access to the sales structure subject to authorization is made on distinct arrangements made on the public domain, other than those corresponding to public alleys. If the sales structure does not have an access road, a statement made under the trader's own responsibility will be submitted.*

Proof of ownership of a privately owned land necessary for parking spaces: for 1 vehicle for every 80 sqm of usable area related to the sales structure within which car maintenance and repair activities are carried out.*
