Automatic recognition of teaching positions in university education obtained in accredited foreign higher education institutions*

The procedure applies within the Technical University of Civil Engineering Bucharest to citizens of member states of the European Union, of the Swiss Confederation, who have obtained the status of PhD supervisor in accredited higher education institutions from member states of the European Union, of the Swiss Confederation, of the European Economic Area, of the Swiss Confederation, and from prestigious universities in other states included in the "List of prestigious universities from other states," approved by order of the Minister of National Education and Scientific Research OMECTS no. 5825/2016 and updated periodically, for the purpose of establishing in Romania. Only in the case of temporary exercise, the provisions of Law no. 200/2004 and Article 296 of the National Education Law no. 1/2001 apply directly.
(1) Reserved or temporarily vacant teaching positions are covered with priority by tenured teaching staff of the institution or by associated teaching staff, through payment by the hour, according to the law.
(2) Employment of specialists with recognized scientific and professional value in the field from the country or from abroad, as invited associated teaching staff, is approved by the associated teaching council, through payment by the hour, according to the law.
Applicants who do not fall under one of the above situations will address themselves directly to the National Center for Recognition and Equivalence of Diplomas within the Ministry of National Education and Scientific Research
Teaching positions obtained at other accredited higher education institutions than those mentioned above are recognized only on the basis of an international mutual recognition agreement, concluded at intergovernmental or interuniversity level.
Study documents subject to recognition are authenticated with the Hague Apostille for states that are parties to the Hague Apostille Convention, while for other states, study documents are superlegalized or accompanied by a certificate of authenticity issued by the competent authorities in the country of origin.
Exemption from apostille or superlegalization is permitted by law, by an international treaty to which Romania is a party, or on the basis of reciprocity.
The Rectorate requests from the Faculty to whose field the teaching position for which recognition is requested belongs, a commission formed of 3 specialists, with a teaching position at least equal to that of the applicant, who within 5 working days, verify and express their opinion on the fulfillment of the conditions for recognition of the evidenced teaching position. If ambiguities are found, the commission requests additional documents from the applicant, who is obliged to submit the requested documents within a maximum of 5 working days.
Otherwise, the commission will reject the recognition request. If the conditions are found to be fulfilled, the commission of specialists will prepare an Analysis Report with the proposal for recognition of the teaching position.
Following the Analysis Report, the UTCB Rector issues the recognition decision. The certificate of recognition of the teaching position is issued by the Rectorate Secretariat within a maximum of 5 working days from notification, according to the model in this procedure.
For the analysis of the files, a processing fee set annually by the University Senate in the UTCB Fee Regulation is charged, which will also include postal fees for correspondence with applicants.

If the committee of specialists does not recognize the teaching position, the applicant will be informed by any means, and will have 48 hours from notification to file an appeal.
The appeal will be resolved within 3 working days by an appeal committee, and the result will be communicated by posting or by email.
