The social benefits remaining uncollected by the deceased person with disabilities (the allowance and/or the complementary personal budget for the month in which the death occurred and, as the case may be, the social benefits due and unpaid until death) are paid to the heir (the surviving spouse, children, parents or, in their absence, other heirs under common law), upon their request. The amounts mentioned above may be requested by the heir from the Territorial Agency for Payments and Social Inspection, within the general statute of limitations, based on the document proving heir status and a declaration on own responsibility that the other heirs (if there are several heirs) do not request these amounts.
