The social benefits remaining uncollected by the deceased person with disabilities, representing the indemnity and/or complementary personal budget for the month in which the death occurred, and, where applicable, the social benefits due and unpaid until death shall be paid to the surviving spouse, children, parents or, in their absence, other heirs, under the general legal provisions, at their request. The amounts mentioned above may be requested from the territorial agency for payments and social inspection by the heir, within the general limitation period, based on the document certifying heir status, as well as, in cases where there are several heirs, a declaration on their own responsibility stating that the other heirs do not request these amounts.

People may submit an appeal within 30 days from the communication to the Tulcea County Agency for Payments and Social Inspection and, in case of dissatisfaction with how the appeal is resolved, may address the court under the provisions of Administrative Litigation Law no. 554/2004, with subsequent amendments and additions.
