The state allowance for children is paid to one of the parents based on their agreement or, in case of disagreement, based on the decision of the guardianship authority or the court ruling, to the parent who has been entrusted with raising and educating the child.

The change of the legal representative for receiving the state allowance is done by submitting a standard application to the Braila County Agency for Payments and Social Inspection, accompanied by supporting documents as applicable:

- in the case of the holder's death - death certificate presented by the other parent, marriage certificate;

- in the case of divorce - court ruling by which the minor/minors are entrusted by the court to the applicant;

- in the case of placement - copy of the placement order issued by the General Directorate of Social Assistance and Child Protection, or the court ruling establishing placement or guardianship to the applicant.

- in the case of adoption - ruling entrusting the child for adoption;
