Social benefits not collected by the deceased person with disabilities, representing the indemnity and/or the complementary personal budget for the month in which the death occurred, and, where applicable, social benefits due and unpaid until death, are paid to the surviving spouse, children, parents or, in their absence, other heirs, under the conditions of common law, upon their request. The amounts provided above may be requested from the territorial agency for payments and social inspection by the heir, within the general prescription period, based on the document certifying heir status, as well as, in the case where there are several heirs, a declaration on their own responsibility that the other heirs do not request these amounts.

The legislation does not contain special provisions regarding appeals; in case of a dispute, the common law provisions apply. Any person who considers themselves harmed in a right or a legitimate interest by a public authority through an administrative act or by the failure to resolve a request within the legal term may address the competent administrative litigation court, in accordance with the provisions of law 544/2004.
