The social benefits remaining uncollected by the deceased person with disabilities, representing the indemnity and/or the personal complementary budget for the month in which the death occurred, and, as the case may be, the social benefits due and unpaid until death, shall be paid to the surviving spouse, children, parents or, in their absence, to other heirs, under the conditions of common law, at their request. The amounts provided above may be requested, at the territorial agency for payments and social inspection, by the heir, within the general statute of limitations, based on the document certifying the status of heir, as well as, in the case where there are several heirs, on the declaration on their own responsibility that the other heirs do not request these amounts.

Legislation does not contain special provisions regarding remedies, in case of dispute the common law provisions are applicable. Any person who considers themselves harmed in a right or a legitimate interest, by a public authority through an administrative act or by the failure to resolve a request within the legal term, may address the competent administrative court, in accordance with the provisions of law 544/2004.
