The obtaining of the siting opinion requested in the Urbanism Certificate, consists of the following steps:

1. Submitting the request and the related documentation, to the Territorial Operation of the company (the competent authority is established depending on the place where the future construction will be executed-

- Note: In the case where the request is addressed incorrectly, it will be redirected to the competent territorial operation for resolution.

MANDATORY CONTENT OF THE DOCUMENTATION:

• Standard request -as per the attached model
• Technical report regarding the construction work in question;
  • Copy of the urbanism certificate;(valid)
  • Location plan in the area, at scale 1:25,000 or 1:10,000; (or at a convenient, illustrative scale)
  • Site plan, signed and stamped, at scale 1:500 (or at a convenient, illustrative scale). The site plan (existing and proposed situation with furnishing) will be signed and stamped and in editable .dwg format will be done in stereo 70 coordinates, and must mandatorily include the placement of constructions within the proposed perimeter, utility connections and road access related to the studied plot. The plan will also include a table with stereo 70 coordinates of the boundary points of the land.

The beneficiary (the applicant) acknowledges that FAILURE TO SUBMIT the documentation in the above-mentioned composition will result in the extension of the processing times.

2. Registration of the request at the territorial operation.

3. Verification of documentation and request for additions, as the case may be;

If the documentation is not submitted in the above composition/format, clarifications will be requested.

Clarifications will also be requested for the issuance fee (when applicable)

CLARIFICATION REQUEST DEADLINE - within a maximum of 10 days (calendar days) from the submission of the initial request.

DEADLINE FOR RESPONSE to clarifications – the beneficiary is obliged to respond to the request for clarifications/additions, pay the fee (when requested) within a maximum of 60 days (calendar days) from the date of receipt of the request for completion.

All clarifications/additions/fees paid are to be sent in a single reply by email.

4. Communication of the fee for the requested type of opinion; issuance of the invoice and/or receipt;

If the applicant does not express their agreement, and does not make the payment, the submitted request cannot continue to be processed, the request will be closed.

Failure to submit the response to clarifications and/or payment of the fee as requested and within the imposed deadline leads to the rejection of the request.

A REJECTION LETTER WILL BE ISSUED and sent to the applicant

5. Allocation of necessary resources and scheduling the site visit; travel to and from the designated location of the TSO’s technical team for identifying and verifying on-site the location for which the opinion is requested; and the ST objectives;

6. Elaboration of the point of view on the documentation by - marking the ST objectives on the layout plan, specifying the GPS coordinates and visa of the layout plan.

NOTE: After this stage, the documentation as a whole will be considered complete; The complete documentation will be assigned a registration number.

7. The complete documentation will be analyzed and the siting opinion issued by the competent structure

• For works located outside the safety zone, the Territorial Operation analyzes the entire documentation and issues the siting opinion.
• For works located within the safety zone, the Territorial Operation will redirect the complete documentation for analysis and approval to the central office in Medias - D.E.M. – serv. A.C.P.C.,

RESOLUTION DEADLINE

• 15 days from the registration of the initial request - when the initial documentation is complete and NO fee is charged.
• 15 days from the submission of clarifications/additions/payment of the fee by the beneficiary -when clarifications/additions/fee have been requested.

8. Sending the opinion to the applicant.

SITING OPINIONS will be received scanned by email indicated in the request.

The opinion can be favorable, conditional, or unfavorable.

The following will be issued:

- a favorable opinion, if when placing the future construction the minimum safety distances provided in Order A.N.R.E. no. 118/2013 approving the Technical Norms for the design and execution of natural gas transmission pipelines are respected.

- an unfavorable opinion, if when placing the future construction the minimum safety distances provided in Order A.N.R.E. no. 118/2013 approving the Technical Norms for the design and execution of natural gas transmission pipelines are NOT respected. In the case of an unfavorable opinion, the reasons that led to the ban on the realization of the construction or work in the ST safety zone will be specified, as well as how a favorable opinion can be obtained. (relocation of the construction or, if possible, rerouting the SNT objectives, at the applicant’s expense)

- a conditional opinion, if the minimum safety distances are respected, but it is necessary to set specific technical conditions, by which the applicant is required to fulfill technical conditions, at his own expense, prior to execution of the construction. Failure to meet these conditions will result in the nullity of the opinion.
