This procedure regulates the method of submitting online applications for the issuance of a certificate from the archive of the Bistrița-Năsăud County Council, according to the provisions of art. 29 of the National Archives Law no. 16/1996, republished, art.44 of the Instructions regarding archive activity for creators and holders of documents, approved by the management of the National Archives through Order of the Day no. 217/1996 and art.3 of Government Ordinance no. 33/2002 regarding the regulation of issuing certificates and attestations by central and local public authorities.
Notes
The resolution deadline according to Art.8 para(1) of Government Ordinance no.27/2002 regarding the regulation of petitions resolution activity, with subsequent amendments and completions, is: “The notified authorities and public institutions have the obligation to communicate to the petitioner, within 30 days from the date of registration of the petition, the answer, regardless of whether the solution is favorable or unfavorable.”
Qualified electronic signature means an advanced electronic signature that is created by a qualified electronic signature creation device and which is based on a qualified certificate for electronic signatures according to the definitions provided in art.3 of EU Regulation no. 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC.
The type of electronic signature applicable by individuals or legal persons for applications submitted online is the qualified electronic signature.
If the applicant does not have the qualified electronic signature, the documents will only be issued after receiving the original application by mail or directly at the registry of the Bistrița-Năsăud County Council.
