The procedure regulates the set of operations leading to the submission of the documentation for granting the insertion incentive.

The insertion incentive is regulated by Government Emergency Ordinance no. 111/2010 concerning the leave and monthly allowance for child raising. The same normative act states that people who return to work earlier cannot be dismissed during the period they receive the insertion incentive, and failure to comply with this provision results in the employer being fined up to 10,000 lei. Exceptions to this law are organizations in bankruptcy or those undergoing judicial reorganization.

Another important mention of GEO no. 111/2010, updated last year, states that the employee must notify the employer at least one month in advance that they will return.

According to Ordinance no. 111/2010, either parent who is on child raising leave and wishes to return to work can benefit from the insertion incentive. Also, if the beneficiary of the incentive earns taxable income for at least 60 days before the child turns two years old, or three years in the case of children with disabilities, the granting of the incentive is extended until the child turns three years old, or four years in the case of children with disabilities.

According to article 7 of GEO no. 111/2010, the value of an insertion incentive is 650 lei, which can only be increased through a government emergency ordinance. It is good to know, however, that the insertion incentive cannot be cumulated with the child raising allowance.

In addition, if you want to benefit from the incentive, you must expressly request it through an official application and its submission to the agency for payments and social inspection. In other words, once you start benefiting from the insertion incentive, you cease to receive the child raising allowance.

Another important thing to be taken into account is the case where you have multiple children. In this situation, you can benefit from child raising leave, monthly allowance, and insertion incentive for each child. The same applies to adopted children, those entrusted for adoption, and those in foster care, except for professional foster parents, who can benefit from the incentive only in the case of their own children.

To benefit from the insertion incentive, the following conditions must be met:

To live with the child/children for whom you are requesting the incentive and to take care of their raising and care;

To have a permanent domicile or legal residence in Romania;

To have earned taxable income for a period of 12 months in the last two years before birth/adoption/guardianship/foster care. Otherwise, you can benefit from the insertion incentive if you can prove that you have received unemployment benefits, health leave, social aid, or disability pension.

In the case where the parents are not married, and the insertion incentive is requested by the child's father, the file must also contain a social investigation report. The social investigation is carried out by the guardianship authority, at the request of the holder of the application for the insertion incentive, through a written request (to which are attached copies of the parents' identity documents and a copy of the child's birth certificate) and registered at our institution.

​Complete files can also be sent by mail, to the Directorate of Social Assistance, Guardianship Authority and Child Assistance, at the address of the Town Hall of Ștefănești, Argeș county.
