Persons classified with a degree of severe handicap with personal assistant have the right to be provided with the employment of a personal assistant paid by the local public authorities or to be granted a monthly allowance if they do not opt for the employment of a personal assistant.

The option is expressed through a written request, which will be forwarded by the Social Assistance Directorate Sibiu to the General Directorate of Social Assistance and Child Protection Sibiu, and becomes valid only based on the written agreement expressed by them.

The above-mentioned monthly allowance is provided in art.42 para.(4) of Law no.448/2006 regarding the protection and promotion of the rights of persons with disabilities, republished, with subsequent amendments and completions and is equal to the net salary of the personal assistant grade 0, established according to the legal provisions regulating the salary level of personnel paid from public funds.

The monthly allowance may be requested only by persons who have their domicile or residence within the Sibiu municipality.

The present procedure establishes the steps to be taken for the approval of the monthly allowance payment, to parents or, as the case may be, legal representatives of the child with severe disability, to the person or family who has taken a child with severe disability into placement, to adults with severe disability or to their legal representatives in case they have opted for this.

The adult with severe disability / his or her legal representative or parents / legal representatives of the child with severe disability / the person or family who has taken a child with severe disability into placement, will submit an application for granting the monthly allowance, only if the document attesting the classification in the degree of disability includes the mention “with personal assistant”.

The payment of the monthly allowance will be made for the validity period of the disability certificate and is grantedstarting from the month following the submission of the application, based on the Order issued by the Mayor of Sibiu Municipality, which will be communicated to the applicant.

The payment can be made by postal mandate or into the applicant’s personal current account.
