Request for license for the public sewage service, provided in the modality of direct management by public services of local or county interest, with legal personality, established and organized by decisions of the deliberative authorities of the administrative-territorial units -

Resolution time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities operator of the completions requested by A.N.R.S.C.
Procedure description: The documents submitted by the applicant for the granting of a license for a public utility service/activity are analyzed by A.N.R.S.C., and if necessary, the regulatory authority sends the applicant a notification informing them of the obligation to make additions, corrections, or clarifications regarding the application and submitted documents, within 30 days from the registration of the documentation.
If, within 30 days from the date of the request for additions, the applicant does not provide all the appropriate documentation stipulated by the regulation, including the requested additions, A.N.R.S.C. will return the relevant documentation, removing the respective request from the license granting procedure, notifying the applicant of this decision.
Depending on the manner of presentation and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:
a) summoning the authorized representatives of the applicant to the headquarters of A.N.R.S.C. to clarify certain aspects that result/do not result from the documentation provided;
b) on-site verification of the accuracy of the data in the documentation transmitted by the applicant.
A.N.R.S.C., through the specialized department, prepares a specialist report including the justified proposal for the granting/refusal of the license, which will be presented for analysis to the Licensing Commission by the secretary of the commission.
The proposal for the granting/refusal of the license is put to a vote in the Licensing Commission.
The granting/refusal of the license is made by order of the President of A.N.R.S.C.
In the case of license granting, A.N.R.S.C. communicates to the applicant the tax invoice for the license granting fee, which must be paid within a maximum of 30 days from the date the invoice is communicated.
After confirmation of payment, A.N.R.S.C. sends to the applicant in a maximum of 5 days, the order of the president of A.N.R.S.C. for granting the license, accompanied by the license and the associated conditions.
In case of non-compliance with the 30-day term for payment of the license granting fee, A.N.R.S.C. will proceed to withdraw the license.
In case of refusal to grant the license, A.N.R.S.C. sends to the applicant in a maximum of 5 days from its issuance, the order of the president of A.N.R.S.C. to refuse the license, accompanied by the reasons for the refusal.
In the situation where the granting of the license has been refused, the applicant may not submit new license documentation earlier than 6 months from the date of issuance of the order of refusal.
Final document:
a) Order for granting the license, accompanied by the license and the conditions associated with the license;
b) Order of refusal of the license, accompanied by the reasons for the refusal;
c) Notification regarding the removal of the request from the procedure.
Notification deadline upon expiry of the resolution term: 5 days from the date of confirmation of payment for the license granting fee, in case of granting the license, or 5 days from the date of issuance of the order for refusal of the license.
