Request for license for the public sanitation service of localities or for one or more specific activities of this service, provided through the delegated management method by specialized providers established as commercial companies - https://www.anrsc.ro/gestiune-delegata-salubrizare/

Processing time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities service operator of the additions requested by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the granting of a license for a public utility service/activity are analyzed by A.N.R.S.C., and in case it is necessary, the regulatory authority sends the applicant a notice informing them of the obligation to make additions, corrections or clarifications, referring to the application and submitted documents, within 30 days from the registration of the documentation.

If , within 30 days from the date of the request for additions, the applicant does not provide all the appropriate documentation stipulated by the regulation, including the required additions, A.N.R.S.C. will return the related documentation, removing the respective application from the license granting procedure, communicating this decision to the applicant.

Depending on how the information is presented and the complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) summoning, at the headquarters of A.N.R.S.C., the authorized representatives of the applicant, to clarify certain aspects that emerge/do not emerge from the submitted documentation;

b) on-site verification of the accuracy of the data in the documentation submitted by the applicant.

A.N.R.S.C., through its specialized department, prepares a specialist report that includes the justified proposal for granting/rejection of the license, which will be presented for analysis to the Licensing Commission, by the secretary of the commission.

The proposal for granting/rejection of the license is submitted to a vote within the Licensing Commission.

The granting/rejection of the license is done by order of the president of A.N.R.S.C.

In case of license granting, A.N.R.S.C. notifies the applicant of the tax invoice regarding the license granting fee, which must be paid within a maximum of 30 days from the date the invoice is communicated.

After payment confirmation, A.N.R.S.C. sends to the applicant, within a maximum of 5 days, the order of the president of A.N.R.S.C. for the granting of the license, accompanied by the license and the associated conditions.

If the deadline of 30 days for payment of the license granting fee is not respected, A.N.R.S.C. will proceed to revoke the license.

In case of refusal to grant the license, A.N.R.S.C. sends to the applicant, within a maximum of 5 days from issuance, the order of the president of A.N.R.S.C. of license rejection, accompanied by the reasons for refusal.

In the situation where the granting of the license has been rejected, the applicant may not submit a new licensing documentation sooner than 6 months from the date of the order of rejection.

Final document:

a) License granting order, accompanied by the license and the associated conditions of the license;

b) License rejection order, accompanied by the reasons for refusal;

c) Notification regarding the removal of the application from the procedure.

Notification deadline at the expiration of the processing period: 5 days from the confirmation of payment of the license granting fee, in case of granting the license, respectively 5 days from the date of issuance of the license rejection order.
