Request for a license for the public sanitation service of localities or for one or more activities specific to this service, provided through delegated management by specialized service providers established as commercial companies - https://www.anrsc.ro/gestiune-delegata-salubrizare/

Resolution time: 60 days from the registration of the documentation or 30 days from the transmission by the public utilities service operator of the additions requested by A.N.R.S.C.

Procedure description: The documents submitted by the applicant for the purpose of granting a license for a public utility service/activity are analyzed by A.N.R.S.C., and in if necessary, the regulatory authority sends the applicant a notice informing them of the obligation to provide additions, corrections, or clarifications, with reference to the request and submitted documents, within 30 days from the registration of the documentation.

If , within 30 days from the date of the request for additions, the applicant does not provide all the required documentation stipulated by regulation, including the requested additions, A.N.R.S.C. will return the related documentation, cancelling the respective request from the license granting procedure, communicating this decision to the applicant.

Depending on the format and complexity of the information contained in the documentation submitted by the applicant, A.N.R.S.C. may decide:

a) to summon, at the A.N.R.S.C. headquarters, the applicant’s authorized representatives, to clarify certain aspects that arise/do not arise from the documentation provided;

b) to verify, on-site, the accuracy of the data from the documentation submitted by the applicant.

A.N.R.S.C., through the specialized department, prepares a specialized report including the justified proposal for license approval/rejection, which will be presented for review by the Licensing Commission, by the secretary of the commission.

The proposal for license approval/rejection is subject to a vote within the Licensing Commission.

The approval/rejection of the license is done by order of the president of A.N.R.S.C.

In the case of license approval, A.N.R.S.C. sends the applicant the invoice regarding the license granting fee, which must be paid within a maximum of 30 days from the date of invoice communication.

After payment confirmation, A.N.R.S.C. sends the applicant, within a maximum of 5 days, the order of the president of A.N.R.S.C. for license granting, accompanied by the license and the associated conditions.

In case of non-compliance with the 30-day deadline for paying the license granting fee, A.N.R.S.C. will proceed with license withdrawal.

In case of license denial, A.N.R.S.C. sends the applicant, within a maximum of 5 days from issuance, the president’s order rejecting the license, accompanied by the reasons for the refusal to grant the license.

In the case where license granting has been rejected, the applicant cannot submit a new licensing file earlier than 6 months from the date of the rejection order.

Final document:

a) Order granting the license, accompanied by the license and the associated license conditions;

b) Order rejecting the license, accompanied by the reasons for the refusal to grant;

c) Notification regarding the cancellation of the request from the procedure.

Notification deadline upon expiration of the resolution time: 5 days from the date of payment confirmation of the license granting fee, in the case of license granting, or 5 days from the date of issuance of the license rejection order.
