The social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the personal complementary budget for the month in which death occurred, and, if applicable, the social benefits due and unpaid up to the date of death, are paid to the surviving spouse, children, parents or, in their absence, to other heirs, according to common law, at their request. The amounts mentioned above can be requested, at the territorial agency for payments and social inspection, by the heir, within the general statute of limitations, based on the document proving the status of heir, as well as, in the case where there are several heirs, a declaration on their own responsibility that the other heirs do not request these amounts.
