The social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary personal budget for the month in which death occurred, and, if applicable, social benefits due and unpaid up to the time of death, shall be paid to the surviving spouse, children, parents, or, in their absence, to other heirs, according to common law, upon their request. The amounts provided above may be requested, from the territorial agency for payments and social inspection, by the heir, within the general statute of limitations, based on the document certifying the status of heir, as well as, in the case where there are several heirs, a statutory declaration that the other heirs are not claiming these amounts.
