The social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the complementary budget for the month in which the death occurred, and, where applicable, the social benefits due and unpaid until death, shall be paid to the surviving spouse, children, parents, or, in their absence, to other heirs, under common law, at their request. The sums mentioned above may be requested at the territorial agency for payments and social inspection by the heir, within the general statute of limitations, based on the document that certifies the status of heir, as well as, in the case where there are several heirs, a declaration on their own responsibility that the other heirs do not request these sums.
