Social benefits remaining uncollected by the deceased person with a disability, representing the indemnity and/or the personal complementary budget for the month in which the death occurred, and, as the case may be, social benefits due and unpaid until death, shall be paid to the surviving spouse, children, parents or, in their absence, to other heirs, according to common law, at their request. The amounts provided above may be requested, at the territorial agency for payments and social inspection, by the heir, within the general prescription period, based on the document certifying the quality of heir, as well as, in the case where there are several heirs, a statement on their own responsibility that the other heirs do not request these amounts.
