Social benefits not collected by the deceased person with disabilities, representing the allowance and/or the complementary budget for the month in which the beneficiary's death occurred, and, as the case may be, the social benefits due and not collected until the date of death, which are paid to the surviving spouse, children, parents or, in their absence, other legal heirs, under common law, at their request.

The amounts provided above may be requested from the territorial agency for payments and social inspection, by the heir, within the general prescription period, based on documents attesting the quality of heir.
