Social benefits remaining uncollected by the deceased person with disabilities, representing the allowance and/or the personal complementary budget for the month in which the death occurred, and, as the case may be, social benefits due and unpaid until the time of death, are paid to the surviving spouse, children, parents or, in their absence, other heirs, under common law upon their request. The amounts mentioned above can be requested at the territorial agency for payments and social inspection by the heir within the general statute of limitations, based on the document attesting the status of heir, as well as, if there are several heirs, a declaration on their own responsibility that the other heirs do not claim these amounts.
